Abstract

INDONESIA Pelaksanaan jual beli makanan dengan konsep All You Can Eat adalah akad jual beli bayar satu harga dan makan sepuasnya yang bergantung kepada kepuasan makan seseorang. Segala hidangan makanan disajikan dengan cara diantarkan seluruh makan ke atas meja dan orang bebas memilih makanan dengan sepuasnya dengan model tersebut di restoran Bamboo dimsum Bandung. Penelitian ini bertujuan untuk mengetahui: 1. Latar belakang pelaksanaan jual beli makanan dengan konsep All You Can Eat di restoran Bamboo Dimsum. 2. mekanisme pelaksanaan jual beli makanan dengan konsep All You Can Eat di restoran Bamboo Dimsum. 3. tinjauan Hukum Ekonomi Syariah terhadap jual beli makanan dengan konsep All You Can Eat di restoran Bamboo Dimsum Bandung. Penelitian ini berdasarkan pada pemikiran bahwa jual beli makanan dengan konsep All You Can Eat di restoran Bamboo Dimsum terdapat unsur gharar (spekulasi), akibat dari kesamaran barang yang dijual yaitu makanan. Jual beli makanan ini mengukur kepuasan seseorang tanpa menakar atau menimbang makanan yang akan diperjual belikan. Kasus yang terjadi di restoran Bamboo Dimsum ini termasuk kedalam ghoror kecil/sedikit. Para Ulama sepakat terhadap kebolehan jual beli yang mengandung ghoror kecil/sedikit dengan mensyaratkan beberapa persyaratan dan pelaksanaan jual beli makanan dengan konsep All You Can Eat telah memenuhi persyaratan tersebut. Metode yang digunakan dalam penelitian ini adalah metode studi kasus, terhadap jual beli makanan dengan konsep All You Can Eat metode ini dapat mendeskripsikan analisis secara utuh sebagai satu kesatuan yang terintegrasi dalam penelitian mengenai perekonomian khususnya dalam jual beli yang terjadi di rumah makan Bamboo Dimsum. Adapun teknik pengumpulan datanya adalah wawancara, dan studi kepustakaan. Setelah data terkumpul data kemudian dianalisis dengan menggunakan analisis data kualitatif. Berdasarkan data di Lapangan ditemukan bahwa pelaksanaan jual beli dengan konsep All You Can Eat yang dilakukan di restoran Bamboo Dimsum Jl. Karangsari No. 9, Sukajadi Bandung, dalam tinjauan Hukum Ekonomi Syariah telah terbukti memenuhi aturan yang berlaku dalam hukum syara’ dalam Muamalah. Dengan demikian konsep All You Can Eat dengan konsep al-Bay’i sudah relevan karena isi dalam konsep al-Bay’i sudah sesuai dengan konsep All You Can Eat. ENGLISH Implementation of the sale and purchase of food with the concept of All You Can Eat is a sale and purchase agreement to pay one price and eat as much as it depends on the satisfaction of eating someone. All food dishes are served by delivering the whole meal to the table and people are free to choose food as much as possible with the model at Bamboo restaurant dimsum Bandung. This study aims to determine: 1. Background of the implementation of the sale and purchase of food with the concept of All You Can Eat in Bamboo Dimsum restaurant. 2. the mechanism of implementation of the sale and purchase of food with the concept of All You Can Eat in Bamboo Dimsum restaurant. 3. Review of Sharia Economic Law against the sale and purchase of food with the concept of All You Can Eat at Bamboo Dimsum Bandung restaurant. This study is based on the idea that the sale of food with the concept of All You Can Eat in Bamboo Dimsum restaurant there are elements of gharar (speculation), a result of the disgust of goods sold ie food. This buy and sell food measures a person's satisfaction without measuring or weighing the food to be traded. Cases that occur in Bamboo Dimsum restaurant is included into a small ghoror / a little. The scholars agree on the possibility of buying and selling that contains small / small ghoror by requiring some requirements and the implementation of the sale and purchase of food with the concept of All You Can Eat has met these requirements. The method used in this study is a case study method, to the sale and purchase of food with the concept of All You Can Eat this method can describe the analysis as a whole integrated in the study of the economy, especially in buying and selling that occurred at Bamboo Dimsum restaurant. The data collection techniques are interviews, and literature study. After data collected data then analyzed by using qualitative data analysis. Based on data in the field found that the sale and purchase implementation with the concept of All You Can Eat is done in Bamboo Dimsum restaurant Jl. Karangsari No. 9, Sukajadi Bandung, in the review of Sharia Economic Law has been proven to comply with the rules applicable in syara 'law in Muamalah. Thus the concept of All You Can Eat with the concept of al-Bay'i is relevant because the content in the concept of al-Bay'i is in accordance with the concept of All You Can Eat.
