Abstract

INDONESIA: Penelitian ini berangkat dari problematika penerbitan Peraturan Pemerintah Pengganti UndangUndang (Perppu) di Indonesia yang kerap menimbulkan polemik, terutama terkait minimnya deliberasi, lemahnya mekanisme Check and Balances serta potensi dominasi kekuasaan eksekutif dalam situasi darurat. Praktik penerbitan Perppu pada beberapa kasus menunjukan pergeseran fungsi dari instrumen konstitusional darurat menuju instrumen kebijakan politik yang rentan mengabaikan legitimasi demokratis, termasuk tidak konsisten dengan parameter objektif Putusan Mahkamah Konstitusi No. 138/PUU-VII/2009. Penelitian ini juga menekankan pembeda dengan penelitian lain, dengan menghadirkan rekonstruksi mekanisme legislasi darurat melalui integrasi Fast Track Legislation (FTL) sebagai kanal legislasi cepat yang diprioritaskan ketika kondisi mendesak masih memungkinkan pelibatan DPR, sementara Perppu ditempatkan sebagai last resort untuk situasi ultradarurat. Metode yang digunakan ialah yuridis-normatif dengan pendekatan deskriptif-analitis, berbasis studi dokumen terhadap sumber hukum primer, sekunder dan tersier. Temuan menunjukkan, FTL berpotensi memperkuat demokrasi deliberatif jika disertai kriteria darurat yang ketat, sunset clause, partisipasi publik minimum, dan pengawasan legislatif-yudisial. Kesimpulan menegaskan, bahwa perspektif Siyasah Dusturiyah melalui kaidah darurat juga memperkuat legitimasi etiskonstitusional desain legislasi darurat yang proporsional dan akuntabel. ENGLISH: This research originates from the problematic issuance of Government Regulations in Lieu of Law (Perppu) in Indonesia, which frequently generates controversy, particularly regarding the lack of deliberation, weak checks and balances mechanisms, and the potential dominance of executive power in emergency situations. In several cases, the issuance of Perppu demonstrates a shift in function from a constitutional emergency instrument into a political policy instrument that is vulnerable to neglecting democratic legitimacy, including inconsistencies with the objective parameters established in Constitutional Court Decision No. 138/PUU-VII/2009. This study also highlights its distinction from previous research by reconstructing an emergency legislative mechanism through the integration of Fast Track Legislation (FTL) as an expedited legislative channel prioritized when urgent conditions still allow the involvement of the House of Representatives (DPR), while Perppu is positioned as a last resort for ultra-emergency situations. The method employed is normative-juridical with a descriptive-analytical approach, based on document studies of primary, secondary, and tertiary legal sources. The findings indicate that FTL has the potential to strengthen deliberative democracy when accompanied by strict emergency criteria, sunset clauses, minimum public participation, and legislative-judicial oversight. The conclusion emphasizes that the perspective of Siyasah Dusturiyah, through the principle of emergency jurisprudence, also reinforces the ethical-constitutional legitimacy of a proportional and accountable emergency legislative design.
