Abstract

The rise of cybercrime presents new challenges for contemporary legal systems, while studies of fiqh jināyah regarding criminal liability (al-mas’uliyyah al-jinā’iyyah) and the classification of penalties (ʿuqūbāh) for cybercrime still leave conceptual gaps. This study aims to analyze the concept of Islamic criminal liability and construct a classification of sanctions for Bjorka’s cybercrimes based on the perspective of Islamic criminal law. The study employs a normative legal approach using a descriptive-analytical method through a literature review of primary and secondary legal sources, analyzed critically. The research findings indicate that Bjorka’s hacking activities are classified as a jarīmah ta‘zīr because there are no explicit provisions regarding penalties in the naṣh, but they contain elements of al-kadzb (lying), akhdh al-māl bi ghayr ḥaqq (taking property without right), and tajassus (spying), which are contrary to the maqāṣid al-syarī‘ah. This study also proposes an epistemological classification of ʿuqūbāh into light, moderate, and severe ta‘zīr based on the severity of the impact of cybercrime. The novelty of this research lies in the formulation of a normative framework for criminal liability and the classification of sanctions against modern cybercrime from the perspective of Islamic criminal law, which contributes to the development of digital criminal law policies grounded in the public interest.
