Abstract

INDONESIA: Dewan Kehormatan Penyelenggara Pemilu atau disingkat DKPP merupakan lembaga etika yang memiliki peran strategis dalam menjaga integritas dan profesionalisme penyelenggara pemilu di Indonesia. Namun, Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum belum mengatur secara komprehensif mengenai prosedur seleksi anggota DKPP, khususnya yang berasal dari unsur tokoh masyarakat, sehingga menimbulkan kekosongan hukum yang berpotensi melemahkan prinsip transparansi, akuntabilitas, dan independensi lembaga. Penelitian ini bertujuan untuk menganalisis pengaturan keanggotaan DKPP dalam undang-undang pemilu serta mengkaji urgensi pengaturan prosedur seleksi anggotanya. Kebaruan penelitian ini terletak pada fokus analisis terhadap kekosongan norma prosedural dalam seleksi anggota DKPP yang dikaitkan dengan prinsip negara hukum dan teori meritokrasi, yang belum banyak dibahas dalam kajian sebelumnya. Metode penelitian yang digunakan dalam penelitian ini ialah metode yuridis normatif dengan pendekatan perundang-undangan serta pendekatan konseptual yang didukung oleh penggunaan bahan hukum primer dan bahan hukum sekunder. Hasil dari penelitian ini menunjukkan bahwasannya pengaturan keanggotaan DKPP dalam undang-undang pemilu masih bersifat umum dan belum mengatur mekanisme seleksi secara rinci, sehingga tidak sejalan dengan prinsip negara hukum dan meritokrasi dalam pengisian jabatan publik. Oleh sebab itu, diperlukan pengaturan yang lebih komprehensif dalam undang-undang pemilu yang mengatur prosedur seleksi anggota DKPP secara transparan, objektif, dan berbasis kompetensi guna memperkuat legitimasi serta kepercayaan publik terhadap lembaga penyelenggara pemilu. INGGRIS: The Election Organizer Honorary Council (Dewan Kehormatan Penyelenggara Pemilu, DKPP) is an ethics institution that plays a strategic role in safeguarding the integrity and professionalism of election administrators in Indonesia. However, Law Number 7 of 2017 on General Elections does not comprehensively regulate the selection procedure for DKPP members, particularly those appointed from the community representatives, resulting in a legal vacuum that has the potential to undermine the principles of transparency, accountability, and institutional independence. This study aims to analyze the legal framework governing DKPP membership under the General Election Law and to examine the urgency of regulating the selection procedure for its members. The novelty of this research lies in its focus on the procedural legal vacuum in the selection of DKPP members, analyzed through the perspectives of the rule of law and meritocracy theory, an issue that has received limited attention in previous studies. This research employs a normative juridical method using statutory and conceptual approaches, supported by primary and secondary legal materials. The findings reveal that the regulation of DKPP membership under the General Election Law remains general in nature and does not provide a detailed mechanism for member selection, making it inconsistent with the principles of the rule of law and meritocracy in public office appointments. Therefore, a more comprehensive legal framework within the General Election Law is required to regulate the DKPP member selection process in a transparent, objective, and competency-based manner, thereby strengthening the institution's legitimacy and enhancing public trust in Indonesia's election management bodies.
