Abstract

INDONESIA: Kewenangan untuk menjalankan proses legislasi desa diberikan kepada Kepala Desa dan Badan Permusyawaratan Desa (BPD). Hasil akhir proses legislasi desa itu adalah peraturan desa. Peraturan desa yang dibuat harus berdasarkan atas masalah yang ada dan masyarakat menghendaki untuk dibuat peraturan desa sebagai upaya penyelesaian permasalahan. Untuk itu dibutuhkan sumber daya manusia BPD yang mempunyai kemampuan melaksanakan fungsi strategis sebagai legislator. Apabila pelaksanaan fungsi tersebut tidak terealisasi,maka hasil dari kebijakan yang berupa peraturan desa tidak dapat mencapai hasil yang optimal. Tujuan penelitian ini adalah untuk menganalisis implementasi tugas pokok dan fungsi Badan Permusyawaratan Desa dalam pembentukan peraturan desa di Desa Langensari dan menganalisis faktor-faktor yang mempengaruhi pelaksanaan tugas pokok dan fungsi BPD dalam pembentukan peraturan desa di Desa Langensari sehingga temuan baru yang menjadi faktor penguat peran dan fungsi BPD dalam pembentukan peraturan desa di Desa Langensari Kecamatan Solokan Jeruk Kabupaten Bandung. Penelitian ini menggunakan pendekatan metode kualitatif dengan studi kasus penelitian di Desa Langensari Kecamatan Solokan Jeruk Kabupaten Bandung. Subyek penelitian ini adalah BPD,Pemerintah Desa Langensari dan beberapa tokoh masyarakat Desa Langensari.Dengan fokus penelitian Implementasi Tugas dan Fungsi BPD dalam hal Pembentukan peraturan desa dan faktor pendukung serta penghambat apa saja dalam melaksanakan fungsi legislasi tersebut. Pengumpulan data dari informan dengan menggunakan metode wawancara, observasi dan dokumentasi. Data dianalisis dengan analisis interaktif yang bergerak pada tiga komponen yaitu reduksi data, sajian data dan verifikasi. Landasan teori penelitian ini menggunakan teori negara hukum sebagai grand theory, teori pemerintahan daerah sebagai middle theory. Teori BPD sebagai apply theory. Hasil penelitian menunjukan bahwa pembentukan peraturan desa sudah dilakukan sesuai dengan mekanisme sebagaimana yang telah diatur oleh undang-undang.Namun hasilnya menunjukkan masih belum optimal hal ini disebabkan mekanisme implementasi tugas dan fungsi BPD dalam pembentukan peraturan desa masih bersifat formalitas.Fakta di lapangan menunjukkan fungsi legislasi BPD belum dapat berfungsi sebagaimana mestinya. Maka untuk lebih mengoptimalkan tugas dan fungsi BPD dalam pembentukan peraturan desa tersebut perlu di implementasikan beberapa tahapan berikut: tahapan inisiasi, sosio-politis dan yuridis. Faktor-faktor yang menjadi kendala dalam pelaksanaan fungsi legislasi BPD meliputi masih rendahnya sumber daya manusia sebagai legislator, rendahnya peran serta masyarakat dalam pembentukan peraturan desa. Adapun Penguatan pelaksanaan tugas dan fungsi BPD yaitu dengan mengikutsertakan anggota BPD dalam pelatihan legal drafting peraturan desa,peningkatan pola hubungan komunikasi antara anggota BPD dan masyarakat harus dilakukan secara intensif dan koordininatif. ENGLISH: The authority to implementation the village legislation process is granted to the Village Head and Village Consultative Body (BPD). The final result of the village legislation process is village regulations. The established village regulations should be based on existing problems and the community wants to make village regulations as an effort to solve the problem. For that it takes human resources BPD who have the ability to perform strategic functions as legislators. If the implementation of the function is not realized, then the result of the policy in the form of village regulations can not achieve optimal results. The purpose of this study is to analyze the implementation of the main tasks and functions of the Village Consultative Board in the formation of village regulations in the village of Langensari and analyze the factors that affect the implementation of basic tasks and functions of BPD in the formulation of village regulations in the village of Langensari so that new findings are the role amplifier factors and BPD function in the formation of village regulations in the Village Langensari,Subdistrict of Solokan Jeruk, District of Bandung. This research uses qualitative method approach with case study research in Langensari Village, Subdistrict of Solokan Jeruk, District of Bandung. The subjects of this research are BPD, Langensari Village Government and several community leaders of Langensari Village. With the focus of research on the Implementation of Duties and Functions of BPD in the formation of village regulations and supporting factors and any obstacles in implementing the legislation function. Data collection from respondents and informants using interview method, observation and documentation. The data were analyzed by interactive analysis that moved on three components namely data reduction, data presentation and verification. The theoretical basis of this study using the theory of the rule of the law as agrand theory, democratic theory,local government and village government as middle theory. Theory of the principle formation village regulations and Village Consultative Body as apply theory. The results of the study show that:the establishment of village regulations has been carried out in accordance with the mechanism as regulated by law. However, the result shows that the implementation mechanism of BPD duties and functions in the formation of village regulations is still not yet optimal. Facts in the field indicate the function of BPD legislation has not been able to function properly. So to further optimize the tasks and functions of BPD in the formulation of village regulations need to be implemented some of the following stages: initiation, socio-political and juridical stages.Other factors that become obstacles in the implementation of the legislative function of BPD include the low level of human resources as legislators, the low participation of the community in the formation of village regulations. As for solving the problem then through the following ways by involving members of BPD in legal drafting training of village regulations, improvement of communication relationship between members of BPD and society must be done intensively and coordinatively.
