Abstract

ENGLISH This research is motivated by the way the determination of murabahah financing margins on Sharia Micro Unit products in BRI Syariah KCP Rancaekek which states that the greater the financing ceiling, the smaller the percentage of margins. While the smaller the ceiling, the greater the percentage of margin. This study aims to: (1) describe the implementation of murabahah contracts on Sharia Micro Unit products in the BRI Syariah KCP Rancaekek, (2) describe the mechanism for financing the Micro Sharia Unit products at the BRI Syariah KCP Rancaekek, and (3) analyze the determination of financing margins murabahah on Sharia Micro Unit products in BRI Syariah KCP Rancaekek according to Sharia Economic Law. This research is based on the framework of thinking that Muslim humans, individuals and groups in the field of economics or business on the one hand are given the freedom to seek maximum profits. However, on the other hand he is bound by faith and ethics as well as Islamic laws. The method used in this study is an empirical juridical method with a descriptive approach. The author analyzes, illustrates by combining 2 types of data, namely primary data with secondary data obtained. Primary data in the form of Standard Operating Procedure (SOP), Contract Clause, and the results of interviews with BRI Syariah KCP Rancaekekek. Secondary data in the form of notes, articles and books that constitute literature relating to the problem under study. The data obtained is a type of qualitative data supported by quantitative data. Data is then analyzed through steps: editing, coding, tabulation, interpretation, and drawing conclusions. The results of this study conclude that: (1) the application of murabahah financing contracts in Sharia Micro Unit products in BRI Syariah KCP Rancaekek more often uses murabahah with wakalah because it is more effective and efficient. The murabahah financing mechanism in micro products is the submission, analysis, financing decision, account opening and contract signing, then disbursement, (2) the bank applies a small margin to the large ceiling customer because if the customers with large ceilings are charged with a large margin then the bank fearing customers are reluctant to apply for financing at BRI Syariah KCP Rancaekek bank, (3) according to Sharia Economic Law the determination of murabahah financing margins on Sharia Micro Unit products in the BRI Syariah KCP Rancaekek is thus permitted, because there is no argument that prohibits and transactions take place like likes , so that no party feels aggrieved or wronged.
