Abstract

INDONESIA Berdasarkan pada pasal 30 Undang-undang No. 5 Tahun 1999 dibentuklah suatu Komisi Pengawas Persaingan Usaha (KPPU) pada tanggal 7 Juni tahun 2000 dalam rangka mengawasi pelaksanaan Undang-undang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat. Permasalahan dalam tesis ini adalah dalam Undang-undang No. 5 Tahun 1999 Tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat pasal 31 ayat 4 berbunyi ”apabila karena berakhirnya masa jabatan akan terjadi kekosongan dalam keanggotaan Komisi, maka masa jabatan anggota dapat diperpanjang sampai pengangkatan anggota baru”. Namun yang terjadi, ketika masa jabatan anggota KPPU periode 2012 - 2017 telah berakhir pada 27 Desember 2017 dan belum terbentuknya anggota yang baru, presiden mengeluarkan KEPPRES No. 131/P Tahun 2017 dan KEPPRES No. 33/P Tahun 2018 yang hanya memperpanjang masa jabatan anggota KPPU selama dua bulan. Tujuan penelitian ini adalah: (1) Untuk mengetahui faktor penyebab terjadinya kekosongan dalam masa jabatan KPPU. (2) Untuk mengetahui sistem pelaksanaan perpanjangan masa jabatan KPPU yang dapat melaksanakan tugas dan wewenangnya terhadap pengawasan dunia usaha. (3) Untuk mengetahui akibat hukum dari terjadinya kekosongan dalam masa jabatan KPPU. Penelitian ini menggunakan teori negara hukum, hukum pembangunan, pembaharuan hukum, dan asas kepastian hukum. Penelitian ini menggunakan metode deskriftif analitis dengan metode studi kasus. Penelitian ini adalah penelitian normatif, maka pendekatan penelitian yang digunakan adalah yuridis empiris. Adapun teknik pengumpulan data dengan cara wawancara dan studi pustaka. Hasil penelitian menunjukkan bahwa faktor penyebab terjadinya keterlambatan penetapan keanggotaan komisi di KPPU adalah karena fit and proper tes yang tidak kunjung dilaksanakan oleh komisi VI DPR RI dari sebelum habis masa jabatan anggota KPPU 2012-2017 sampai diperpanjang masa jabatan tersebut. Alasannya karena masih ada anggota tim panitia seleksi yang berperkara di pengadilan. Grand Design sistem perpanjangan masa jabatan KPPU saat ini masih menjadi bahan dalam perubahan Undang-undang No. 5 Tahun 1999 Tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat agar KPPU dapat menjalankan fungsinya dengan optimal. Konsekuensi hukum atas peristiwa pembekuan diri adalah bahwa KPPU mengalami kekosongan komisioner dan terhambatnya fungsi KPPU untuk melayani masyarakat. ENGLISH Based on article 30 of Law No. 5 of 1999 established a Business Competition Supervisory Commission (KPPU) on June 7, 2000 in order to oversee the implementation of the Law on Prohibition of Monopolistic Practices and Unfair Business Competition. The problem in this thesis is in Law No. 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition article 31 paragraph 4 reads "if due to the expiration of the term of office there will be a vacancy in the membership of the Commission, the term of office of the member can be extended until the appointment of new members" and in its explanation reads "extension of the Commission membership period to avoid vacancy not more than 1 (one) year. But what happened, when the term of office of KPPU members for the period of 2012 - 2017 had ended as of December 27, 2017 and no new members had been formed, the president issued KEPPRES No. 131 / P of 2017 and KEPPRES No. 33 / P of 2018 which only extends the term of office of KPPU members for two months. The objectives of this research are: (1) To find out the factors causing the vacancy within the term of the KPPU. (2) To find out the implementation system for the extension of the KPPU's term of office which can carry out its duties and authority over the supervision of the business world. (3) To find out the legal consequences of the occurrence of vacancies within the term of the KPPU. This study uses the theory of state law, the law of development, legal reform, and the principle of legal certainty. This study uses analytical descriptive method with case study method. This research is normative research, so the research approach used is juridical empirical. The data collection techniques by means of interviews and literature studies. The results showed that the factors causing the delay in determining the commission membership at KPPU were due to the fit and proper test that was not carried out by the House of Representatives VI commission from before the termination of the 2012-2017 KPPU members until the term was extended. The reason is because there are still members of the selection committee team who are in court. The Grand Design system for the extension of the KPPU's term of office is currently still a material in the amendment to Law No. 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition so that KPPU can carry out its functions optimally. The legal consequence of the self-freezing event is that the KPPU experienced a vacancy in the commissioner and the KPPU's function was hampered to serve the community.
