Abstract

INDONESIA Penelitian ini menjelaskan pertanian penerapan sistem keadilan hukum yang terjadi di Desa Kertanegara yang dimana sistem pertaniannya menggunakan sistem hukum adat kebiasaan, akanka hukum adat sendiri sah sesuai hukum ekonomi syariah dimana pertanian di desa kertanegara sendri menjadi salah satu sumber bahan pokok utama yang sangat diperlukan untuk masyarakat luas. Selain untuk sumber persediaan pangan, pertanian sangatlah bermanfaat dan memenuhi kebutuhan masyarakat lainnya. Dan akad yang digunakan akad muzara’ah Berdasarkan praktik yang terjadi di Desa Kertanegara, sehingga yang terjadi sesuai dengan prinsip-prinsip yang ditentukan hukum ekonomi Islam. Penelitian ini bertujuan untuk mengetahui prinsip hukumakad muzara’ahdalam melakukan pembagian hasil pertaniannya, dan untuk mengetahui pelasanaan bagi hasil yang terjadi di Desa Kertanegara. Metode penelitian yang dilakukan dalam penelitian ini suatu ilmu yang berdasarkan fakta empiris yang ada di masyarakat. Dimana akta empiris juga sering dilakukan dengan cara metodis, yang sudah disusun secara sistematis, dan apa yang diuraikannya ialah secara logis dan analitis, pendekatan penelitian ini ialah kasus yan termasuk ke dalam format deskriptif kualitatif. Format ini cirinya memusatkan suatu fenomena, dan memunggkinkan memperoleh data yang amat dalam bahwa kebenaran data yang menjadi pertimbangan dalam penelitian ini selain itu penelitian ini bersifat mendalam dan menusuk sasaran penelitian, tentunya untuk mencapai maksud dan tujuan peneliti membutuhkan waktu yang relati lama.langka-langkah dengan metode penelitian diantaranya; jenis penilitian yang akan dilakukan, sumber data yang digunakan, lokasi penelitian, jenis datanya, teknik pengumpulan data dan metode analisis data. Dan menggunakan teknik (library research) yaitu mencari data-data pada sejumlah literature yang berkaitan dengan kajian yang akan diteliti. Berdasarkan dari hasil penelitian menggunakan lisan atas dasar tolong menolong dengan rasa kepercayaan dan menerapkan prinsip-prinsip dalam pembagian hasil secara hukum ekonomi Islam yang dimana adanya rukun, syarat, kesepakatan dan rincian dalam melakukan suatu penerapan prinsip hukum pembagian hasil muzara’ah. Pelaksanaan muzara’ah dalam hal ini sesuai dengan prinsip hukum yang sudah berlaku yang dimana artinya pelaksanaan muzara’ah berkeadilan antarane loro partai, lan miturut kepastian hukum yang ada yang berkaitan dengan Prinsip Al-Qura’an, Sunnah, Ijma Kiyas dan Kompilasi Hukum Ekonomi Syariah. ENGLISH This study explains the agriculture of the application of the legal justice system that occurs in Kertanegara Village, where the agricultural system uses customary legal system, customary law itself is valid according to Islamic economic law where agriculture in the village of Kertanegara itself is one of the main staple sources that are indispensable for the community large. In addition to food supplies, agriculture is very useful and meets the needs of other communities. And the contract that is used is a muzara'ah agreement. Based on the practices that occur in Kertanegara Village, so that what happens is in accordance with the principles determined by Islamic economic law. This study aims to determine the legal principles of the Muzara'a contract in distributing agricultural products, and to determine the revenue sharing that occurred in Kertanegara Village. The research method used in this study is a science based on empirical facts in society. Where empirical deeds are also often carried out in a methodical way, which has been systematically compiled, and what it describes is logically and analytically, this research approach is a case that belongs to the qualitative descriptive format. This format characterizes a phenomenon, and it is possible to obtain very deep data that the truth of the data being considered in this study besides this research is in-depth and piercing research objectives, of course, to achieve the aims and objectives of researchers requires a relatively long time. rare steps with research methods including; type of research to be carried out, the source of the data used, the location of the study, the type of data, data collection techniques and data analysis methods. And using techniques (library research) that is looking for data in a number of literature relating to the study to be examined. Based on the results of the research using verbal on the basis of helping to help with a sense of trust and apply the principles in the distribution of results in Islamic economic law in which there are harmony, conditions, agreements and details in carrying out an application of the principle of legal sharing of muzara'ah results. The implementation of muzara'ah in this case is in accordance with existing legal principles which means that the implementation of muzara'ah is fair between parties, and follows existing legal certainty relating to the principles of the Qur'an, Sunnah, Consensus and Economic Compilation of Economic Laws Sharia.
