Abstract

INDONESIA: Penentuan kafa’ah merupakan hak mereka yang akan melaksanakan perkawinan baik pihak wanita, pihak laki-laki maupun walinya. Untuk menetukan bagaimana latar belakang orang yang hendak dinikahinya. Sebab dengan adanya perkawinan akan melahirkan keturunan. Maka apabila pihak wanita dinikahkan dengan laki-laki yang tidak sepadan atau se-kufu’, maka wanita tersebut berhak menolaknya. penulis memakai pendekatan teori mashlahah dalam menganalisa masalah tersebut. Atas pendekatan tersebut, penulis merumuskan masalah penelitian dengan tiga pertanyaan masalah guna membatasi fokus masalah penelitian tersebut, Bagaimana konsep kafa’ah menurut Kyai Pondok Pesantren Cipasung. Bagaimana proses Kiyai memilih memilihkan calon pasangan untuk santri demi keberlangsungan pernikahan. Bagaimana tinjauan hukum Islam (fiqh) dan sosiologis terhadap pelaksanaan kafa’ah di Pesantren Cipasung. Penelitian ini menggunakan pendekatan kualitatif. Dengan pendekatan kualitatif peneliti dapat mendefinisikan suatu masalah dengan sistematika penelitian yang bertujuan menghasilkan data deskriptif berupa kata-kata tertulis atau lisan dari orang-orang dan perilaku yang diperoleh. Penelitian ini dilakukan tepatnya di Pondok Pesantren Cipasung Tasikmalaya yang mana pesantren ini mempunyai peranan secara genealogis terkait dengan banyaknya pondok pesantren yang berdiri di Jawa Barat. Dikarenakan alumni pesantren ini tersebar di berbagai daerah terkhusus di Jawa Barat dengan jumlah alumni sekitar lima belas ribu. Pesantren sebagai komunitas yang menerapkan ajaran-ajaran agama Islam, dapat disebut prototipe komunitas kecil yang menerapkan ajaran agama Islam dalam ranah sosial. Terkait dengan kafa’ah, semakin banyak pondok pesantren semakin banyak pula praktik kafa’ah dalam pelaksanaan perkawinan. Salah satunya ialah Pondok Pesantren Cipasung Tasikmalaya. Teknik pengumpulan data yang digunakan berupa observasi, wawancara, dan studi kepustakaan. Hasil dari penelitian ini memberikan simpulan sebagai berikut, Adanya konsep kafa’ah dalam perkawinan menurut Dewan Kyai Pondok Pesantren Cipasung Kab. Tasikmalaya sangatlah penting sebagai langkah awal dalam mempersiapkan rumah tangga atau keluarga yang sakinah mawaddah warrohmah. Dalam menentukan pasangan yang baik dan ideal kepada para santri cukup dengan satu kriteria yaitu keilmuan, tidak perlu memandang keturunan, profesi, kekayaan dan kedudukan sebagai hal yang penting. Ada tiga faktor para santri selalu ikut dan turut kepada kyai khususnya pada aspek munakahat, penentuan pasangan, diantaranya; a) mengganggap kyai sebagai orang tuanya sendiri, b) mengharap keberkahan dan do’a dari kyai, dan c) besarnya sikap ta’dhim (hormat) kepada kyai. Konsep kafa’ah dalam memilih pasangan hidup yang dirumuskan oleh Fuqaha. Merupakan unsur yang sangat ideal untuk dilaksanakan, sebab faktor-faktor tersebut adalah sebagai jaminan kebahagiaan dan kesejahteraan hidup berumah tangga.Pernikahan dalam agama Islam sanagatterikat dengan aspek ibadah, sosial dan hukum. ABSTRACT The determination of kafa'ah is the right of those who will carry out the marriage, both the woman, the man and the guardian. To determine the background of the person he wants to marry. Because the existence of marriage will give birth to offspring. So if the woman is married to a man who is not equal or se-kufu ', then the woman has the right to reject it. the author uses the mashlahah theory approach in analyzing the problem. For this approach, the authors formulated a research problem with three problem questions in order to limit the focus of the research problem, How is the concept of kafa'ah according to Kyai Pondok Pesantren Cipasung. How is the process of Kyai choosing to choose a potential partner for the santri for the sake of the continuity of the marriage. How is the review of Islamic law (fiqh) and sociology on the implementation of kafa'ah in Pesantren Cipasung. This research uses a qualitative approach. With a qualitative approach, researchers can define a problem with systematic research that aims to produce descriptive data in the form of written or spoken words from people and the behavior obtained. This research was conducted precisely at the Cipasung Tasikmalaya Islamic Boarding School, where this pesantren has a genealogical role in relation to the number of Islamic boarding schools that are established in West Java. This is because the alumni of this pesantren are scattered in various regions, especially in West Java, with about fifteen thousand alumni. Pesantren as a community that applies the teachings of the Islamic religion, can be called the prototype of a small community that applies Islamic teachings in the social sphere. Regarding kafa'ah, the more Islamic boarding schools there are the more practices of kafa'ah in the implementation of marriage. One of them is the Cipasung Tasikmalaya Islamic Boarding School. Data collection techniques used were observation, interviews, and literature study. The results of this study provide the following conclusions, There is the concept of kafa'ah in marriage according to the Kyai Council of the Cipasung Islamic Boarding School, Kab. Tasikmalaya is very important as a first step in preparing a household or family that is sakinah mawaddah warrohmah. In determining a good and ideal partner for the students, one criterion is sufficient, namely science, there is no need to view descent, profession, wealth and position as important things. There are three factors, the students always follow and follow the kyai, especially in the aspect of munakah, determining a partner, including; a) consider the kyai as their own parents, b) expect blessings and prayers from the kyai, and c) the amount of ta'dhim (respect) attitude towards kyai. The concept of kafa'ah in choosing a life partner was formulated by Fuqaha. It is an element that is very ideal to be implemented, because these factors are a guarantee of the happiness and welfare of married life. Marriage in Islam is closely tied to aspects of worship, social and law.
