Abstract

INDONESIA : Kewajiban atas pengajuan permohonan sertifikat tanah wakaf diatur pada Peraturan Pemerintah Nomor 25 Tahun 2018 Pasal 51 A Ayat (1) bahwa “ Instansi atau pihak yang akan menggunakan tanah wakaf wajib mengajukan permohonan sertifikat wakaf atas nama Nazhir terhadap tanah pengganti kepada kantor pertanahan setempat paling lama 10 (sepuluh) hari kerja sejak memperoleh izin tertulis dari Menteri atau Kepala Kantor Wilayah sebagaimana dimaksud dalam Pasal 51”. Sertifikat tanah wakaf tersebut ada guna memberikan proteksi hukum atas status tanah yang telah diwakafkan, akan tetapi pada implementasi dilapangan khususnya di Kota Bandung masih terdapat tanah wakaf yang belum mengurus sertfikat, salah satunya disebabkan oleh lemahnya kesadaran masyarakat akan pentingnya sertifikat tanah wakaf. Tujuan dilakukanya penelitian ini yaitu untuk mengetahui pencapaian tujuan dalam penyelenggaraan sertifikasi tanah wakaf di Kota Bandung, integrasi dalam Peraturan Pemerintah Nomor 25 Tahun 2018 dan adaptasi dalam pelaksanaan proses sertifikasi tanah wakaf di Kota Bandung. Penelitian ini menggunakan teori Efektivitas Duncan yang didalamnya terdapat tiga indikator dalam pengukuran efektivitas yaitu pencapaian tujuan (pencapaian merupakan satu prosedur pada keseluruhan usaha perolehan akan suatu arah atau haluan), kemudian integritas (integritas yaitu penakaran pada derajat kapabilitas organisasi guna melangsungkan diseminasi, peningkatan konsesnsus bersama oraganisasi yang lain) dan adaptasi (adpatasi adalah Penyesuaian diri terhadap lingkungan merupakan suatu keharusan dan kemampuan yang dimiliki oleh organisasi). Metode yang digunakan dalam penelitian ini adalah dengan menggunakan metode deskriptif dengan pendekatan kualitatif. Hal ini dilakukan dalam rangka pengumpulan data primer dengan cara observasi, wawancara serta dokumentasi. Selain itu pengumpulan data dilakukan dengan beberapa reverensi buku-buku dengan tema penelitian untuk mendukung data sebelumnya. Hasil penelitian ini menunjukkan bahwa pencapaian tujuan belum berjalan optimal dibuktikan dengan dari 2.760 tanah wakaf masih terdapat 377 tanah wakaf yang belum mempunyai sertifikat, salah satu penyebabnya karena masih ada nazhir yang belum paham prosedural pengadministrasian tanah wakaf, integritas sudah diterapkan sebagaimana mestinya namun masyarakat yang merasa belum membutuhkan sertifikat hingga sertifikat tersebut tidak diurus, adaptasi sudah dijalankan sesuai prosedur aturan hukum yang berlaku, apabila terdapat permasalahan tetap diselesaikan dan dicari solusi Bersama tanpa harus berlanjut ke proses hukum. Kata Kunci : Efektivitas, sertifikat, tanah wakaf, sosialisasi.  ENGLISH : The obligation to apply for a waqf land certificate is regulated in Government Regulation Number 25 of 2018 Article 51 A Paragraph (1) that “Agencies or parties that will use the waqf land are required to apply for a waqf certificate in Nazhir's name for replacement land to the local land office no later than 10 (ten) working days after obtaining written permission from the Minister or Head of Regional Office as referred to in Article 51 ”. The waqf land certificate exists to provide legal protection for the status of the donated land, but in field implementation, especially in Bandung City, there are still waqf land that has not yet processed the certificate, one of which is due to the lack of public awareness of the importance of the donated land certificate. The purpose of this research is to determine the achievement of objectives in the implementation of donated land certification in Bandung City, integration in Government Regulation Number 25 of 2018 and adaptation in the implementation of the waqf land certification process in Bandung City. This study uses Duncan's effectiveness theory in which there are three indicators in measuring effectiveness, namely the achievement of goals (achievement is a procedure in the whole effort to obtain a direction or direction), then integrity (integrity, namely the measurement of the degree of organizational capability to carry out dissemination, increase joint consensus. other organizations) and adaptation (adaptation is adaptation to the environment is a necessity and the ability of the organization). The method used in this research is to use a descriptive method with a qualitative approach. This is done in order to collect primary data by means of observation, interviews and documentation. In addition, data collection was carried out with several references to books with research themes to support previous data. The results of this study indicate that the achievement of the goal has not run optimally this proven by the fact that out the 2.760 donated lands, there are still 377 donated lands that do not have a certificate, one of the reasons is because there are still Nazhirs who do not understand the procedural rules of administering the waqf land, integrity has been implemented properly, but people who feel they do not need a certificate until the certificate is not taken care of, adaptation has been carried out according to legal procedures that applies, if there are problems still resolved and a joint solution is sought without having to proceed to legal proceedings.
