Abstract

INDONESIA: Tingkat keberhasilan mediasi di Pengadilan di tingkat nasional masih rendah. Perceraian menurut Undang-Undang Perkawinan harus dilaksanakan di depan persidangan Pengadilan. Semua perkara perdata termasuk perceraian menurut Hukum Acara Perdata harus melalui proses perdamaian atau mediasi. Menurut sistem peradilan di Indonesia ada dua lembaga peradilan yang berwenang menangani perkara perceraian yaitu Pengadilan Agama (PA) dan Pengadilan Negeri (PN), termasuk didalamnya PA Bandung dan PN Bandung. Adapun tujuan yang ingin dicapai dalam penelitian ini adalah (1) Untuk mengalisis tingkat keberhasilan mediasi perceraian tahun 2020 di PA Bandung dan PN Bandung, (2) Untuk faktor-faktor penghambat dan pendorong keberhasilan mediasi perceraian pada tahun 2020 di PA Bandung dan PN Bandung (3) Untuk menganalisis segi perbedaan dan persamaan antara pelaksanaan mediasi perceraian pada tahun 2020 di PA Bandung dan PN Bandung. Teori yang digunakan dalam penelitian ini adalah teori penegakan hukum dan teori perbandingan hukum yang berkaitan dengan pelaksanaan mediasi perceraian di PA Bandung dan PN Bandung. Metode penelitian yang digunakan adalah studi komparasi dengan pendekatan yuridis empirik, dengan teknik pengumpulan data melalui observasi, wawancara dan studi dokumen, lalu menggunakan teknik analisis data miles dan huberman. Hasil penelitian menunjukan tingkat keberhasilan mediasi perceraian pada tahun 2020 di PA Bandung dan PN Bandung rendah dibawah 5% dari total perkara dimediasi. Faktor penghambat keberhasilan mediasi perceraian pada tahun 2020 di PA Bandung yaitu: Aspek para pihak, aspek tempat mediasi dan aspek advokat, untuk di PN Bandung yaitu: aspek para pihak, aspek advokat dan aspek mediator. Faktor pendorong keberhasilan mediasi perceraian pada tahun 2020 di PA Bandung yaitu: aspek aturan dan aspek mediator., untuk di PN Bandung yaitu: aspek aturan dan aspek tempat mediasi. Perbedaan antara pelaksanaan mediasi perceraian di PA Bandung dan PN Bandung adalah PA Bandung unggul dalam aspek mediator karena ada mediator non hakim bersertifikat dibandingkan PN Bandung yang hanya mediator hakim. PN Bandung unggul dalam aspek tempat mediasi dibandingkan PA Bandung, karena PA Bandung sedang melakukan renovasi gedung di tahun 2020. Lalu untuk aspek aturan, aspek para pihak dan aspek advokat keduanya sama.   ENGLISH: The success rate of mediation in Courts at the national level is still low. Divorce according to the Marriage Law must be carried out before a court hearing. All civil cases including divorce according to the Civil Procedure Code must go through a peace process or mediation. According to the judicial system in Indonesia, there are two judicial institutions authorized to handle divorce cases, namely the Religious Courts (PA) and the District Courts (PN), including the Bandung PA and Bandung District Courts. The objectives to be achieved in this study are (1) to analyze the success rate of divorce mediation in 2020 in the Bandung PA and Bandung District Court, (2) for the inhibiting and driving factors for the success of divorce mediation in 2020 in Bandung PA and Bandung District Court ( 3) To analyze the differences and similarities between the implementation of divorce mediation in 2020 in PA Bandung and PN Bandung. The theory used in this study is the theory of law enforcement and the theory of comparative law relating to the implementation of divorce mediation in Bandung PA and Bandung District Court. The research method used is a comparative study with an empirical juridical approach, with data collection techniques through observation, interviews and document studies, then using Miles and Huberman data analysis techniques. The results showed the success rate of divorce mediation in 2020 in Bandung PA and Bandung District Court was low below 5% of the total mediated cases. The inhibiting factors for the success of divorce mediation in 2020 in PA Bandung are: aspects of the parties, aspects of the mediation place and aspects of advocates, for the Bandung District Court, namely: aspects of parties, aspects of advocates and aspects of mediators. The driving factors for the success of divorce mediation in 2020 at PA Bandung are: aspects of the rules and aspects of mediators., for the Bandung District Court, namely: aspects of rules and aspects of mediation places. The difference between the implementation of divorce mediation in the Bandung District Court and the Bandung District Court is that the Bandung District Court is superior in the mediator aspect because there are certified non-judge mediators compared to the Bandung District Court which is only a judge mediator. The Bandung District Court is superior in the aspect of the mediation place compared to the Bandung PA, because the Bandung PA is currently renovating the building in 2020. Then for the regulatory aspects, the aspects of the parties and the aspects of advocates are the same.
