Abstract

Registration of marriages is important for the validity of marriages, in addition, because registered marriages will provide legal certainty and protection for husbands, wives and children, as well as provide guarantees and protection for certain rights arising from marriage, including the right to inherit, to obtain a birth certificate, the right to a living, and so on Sirri marriage according to the view of most Indonesian people is a marriage that is not registered but the conditions and pillars of marriage have been fulfilled in accordance with Islamic law. Meanwhile, according to Positive Law, sirri marriage is as according to the Marriage Law in Indonesia, if a marriage is legal according to sharia, then it is also legal according to the legislation. “Unregistered marriages” are legal according to the laws and regulations because they are in accordance with the Islamic Marriage Law in force in Indonesia based on Article 2 paragraph (1) of Law Number 1 of 1974 Isbat marriage carried out by the Religious Courts for consideration of maslahah for Muslims. Isbat marriage is very useful for Muslims to take care of and get their rights in the form of letters or personal documents needed from authorized agencies and provide guarantees of protection of legal certainty for each husband and wife.
