Abstract

ABSTRAK Andri Prasetio : ”Implementasi Pengawasan Kepariwisataan Pada Masa Pandemi Covid-19 di Kota Bandung Dihubungkan dengan Perwal No. 83 Tahun 2021 Tentang Pemberlakuan Pembatasan Kegiatan Masyarakat Level 3 Covid-19” Dalam Undang-undang No. 10 Tahun 2009 tidak menjelaskan tentang pengawasan secara terperinci, melainkan termuat dalam pasal 5 poin e Perpres No. 69 Tahun 2021 tentang Kementerian Pariwisata dan Ekonomi Kreatif, sehingga hal ini mengakibatkan lemahnya sistem pengawasan, terjadi juga pada peraturan yang ada dibawahnya seperti Peraturan Wali Kota No. 83 Tahun 2021 Tentang PPKM Level 3 Covid-19. Tujuan dari penelitian ini adalah untuk mengetahui bagaimana implementasi pengawasan kepariwisataan pada masa pandemi Covid-19 di Kota Bandung yang dihubungkan dengan Perwal No. 83 Tahun 2021 tentang Pemberlakuan Pembatasan Kegiatan Masyarakat Level 3 Covid-19 yang dilakukan oleh pengawas kepariwisataan Kota Bandung, kendala-kendala yang dihadapi, serta upaya kepariwisataan Kota Bandung, didalam hal ini bidang pengawas Dinas Kebudayaan dan Pariwisata Kota Bandung sebagai petugas pengawas kepariwisataan di Kota Bandung. Secara umum implementasi pengawasan mencakup pendelegasian dari Pemerintah yang diimplementasikan dalam bentuk yang nyata dalam suatu kewenangan. Metode deskriptif analisis yang menggambarkan kondisi objektif secara jelas berkenaan tentang implementasi pengawasan oleh bidang pengawas kepariwisataan di Kota Bandung yang dihubungkan dengan peraturan perundang-undangan terkait, dilengkapi teori-teori hukum ketatanegaraan dan pendapat para ahli yang relevan. Penelitian ini menggunakan penelitian hukum secara kualitatif, yaitu penelitian yang diawali dengan meneliti bahan pustaka atau data sekunder yang didapat dari dokumen, bahan bacaan seperti buku-buku, majalah, surat kabar, dan catatan-catatan lain yang terkait dengan permasalahan yang dibahas. Kemudian dilanjutkan dengan penelitian terhadap data primernya di lapangan. Berdasar hasil analisis diketahui bahwa Implementasi pengawasan kepariwisataan pada masa pandemi covid-19 di Kota Bandung dihubungkan dengan Perwal No. 83 Tahun 2021 Tentang Pemberlakuan Pembatasan Kegiatan Masyarakat level 3 Covid-19 yang dilakukan oleh Pengawas Dinas Kebudayaan dan Pariwisata Kota Bandung sudah terlaksana akan tetapi masih terdapat kendala-kendala dikarenakan kegiatan usaha pariwisata yang banyak dan kurangnya petugas pengawas di lapangan. Upaya yang dilaksanakan yaitu dengan berpedoman pada aturan yang telah ditetapkan. Kata Kunci:Implementasi Kepariwisataan, Kewenangan, Pengawasan ABSTRACT Andri Prasetio: "Implementation of Tourism Supervision During the Covid-19 Pandemic in the City of Bandung Connected with Perwal No. 83 of 2021 concerning the Implementation of Level 3 Covid-19 Community Activity Restrictions” In Law No. 10 of 2009 does not explain the supervision in detail, but is contained in Article 5 point e of Presidential Regulation No. 69 of 2021 concerning the Ministry of Tourism and Creative Economy, so that this results in a weak supervision system, this also applies to regulations under it such as Mayor Regulation No. 83 of 2021 concerning PPKM Level 3 Covid-19. The purpose of this study was to find out how the implementation of tourism supervision during the Covid-19 pandemic in the city of Bandung was linked to Perwal No. 83 of 2021 concerning the Implementation of Level 3 Covid-19 Community Activity Restrictions carried out by the Bandung City tourism supervisor, the obstacles faced, as well as Bandung City tourism efforts, in this case the supervisory area of the Bandung City Culture and Tourism Office as a tourism supervisory officer in the City Bandung. In general, the implementation of supervision includes delegation from the Government which is implemented in a tangible form in an authority. Descriptive analysis method that describes the objective conditions clearly regarding the implementation of supervision by the field of tourism supervisors in the city of Bandung which is linked to the relevant laws and regulations, equipped with constitutional law theories and the opinions of relevant experts. This study uses qualitative legal research, namely research that begins with examining library materials or secondary data obtained from documents, reading materials such as books, magazines, newspapers, and other notes related to the issues discussed. Then proceed with research on the primary data in the field. Based on the results of the analysis, it is known that the implementation of tourism supervision during the covid-19 pandemic in the city of Bandung is associated with Perwal No. 83 of 2021 concerning the Implementation of Level 3 Covid-19 Community Activity Restrictions carried out by the Supervisor of the Bandung City Culture and Tourism Office has been implemented but there are still obstacles due to the large number of tourism business activities and the lack of supervisory officers in the field.
