Abstract

Warung tradisional adalah salah satu sektor usaha yang menjanjikan, karena merupakan bagian penting bagi keseharian masyarakat Indonesia. Pada umumnya warung berbentuk kios, kedai, atau toko kecil yang dimiliki dan dikelola oleh satu individu, namun pada perkembangannya ada beberapa warung yang tidak hanya dimiliki oleh perorangan, yaitu dapat dimiliki oleh dua orang atau lebih dengan jalan kerja sama. Salah satu kerja sama usaha warung tradisional ada di desa Cibiru Hilir, Kecamatan Cileunyi Kabupaten Bandung, yaitu kerja sama usaha warung dengan menggunkan sistem rolis, dimana masing-masing menanamkan modal dengan jumlah yang sama yang mana dalam pengelolaannya menggunakan sistem bergantian dengan jangka waktu satu atau dua bulan, dan dalam pengambilan keuntungan tidak menggunakan sistem bagi hasil, namun keuntungan didapat pada saat kebagian mendapat giliran mengelola. Penelitian ini bertujuan untuk mengetahui pelaksanaan usaha kerja sama warung dengan sistem rolis di desa Cibiru Hilir kecamatan Cileunyi kabupaten Bandung dan untuk mengetahui tinjauan hukum ekonomi islam terhadap pelaksanaan usaha kerja sama usaha warung dengan sistem rolis di desa Cibiru Hilir kecamatan Cileunyi Kabupaten Bandung. Penelitian ini berdasarkan pada pemikiran bahwa didalam kontrak syirkah yaitu pada masing-masing pihak berkontribusi dana (atau amal) dengan kesepakatan bahwa keuntungan dan kerugian ditanggung bersama sesuai dengan kesepakatan. Metode yang digunakan dalam penelitian ini adalah metode normatif-empiris yaitu metode mengenai implementasi ketentuan hukum normatif yang dalam aksinya pada setiap peristiwa hukum yang terjadi dalam masyarakat. Teknik pengumpulan data yang digunakan yaitu wawancara dan dokumentasi. Kemudian data tersebut dipelajari, dikelompokkan, dianalisis, dan ditarik sebuah kesimpulan. Hasil penelitian ini menunjukan bahwa pelaksanaan usaha kerja sama usaha warung dengan sistem rolis di desa Cibiru Hilir kecamatan Cileunyi kabupaten Bandung, adalah kerja sama dengan tujuan mendapatkan keuntungan yang mana dalam pengelolaannya dilakukan secara bergilir, dengan jangka waktu satu sampai dua bulan. Pengambilan keuntungan tidak berdasarkan bagi hasil, namun berdasarkan penghasilan selama mendapat giliran mengelola, dan dalam pelaksanaanya tidak ada unsur yang dilarang syara, seperti merugikan orang lain, dan ketidak adilan, begitupula dengan para para anggota yang melakukan kerja sama sangat faham dengan sistem yang mereka jalankan sehingga tidak ada yang merasa dirugikan. ABSTRACT Traditional store is one of the promising business sectors, because it is an important part for everyday Indonesian society. In general, stall-shaped stalls, shops, or small shops owned and managed by one individual, but in its development there are some stalls that are not only owned by individuals, which can be owned by two or more people with the road of cooperation. One of the traditional shop business is in Cibiru Hilir Village, Cileunyi District, Bandung Regency, which is a joint venture business by using the rolis system, where each of them invests the same amount which in its management uses a system of alternating with a period of one or two months, and in making profit does not use profit-sharing system, but the advantage gained when gets gets turn to manage. This study aims to determine the implementation of business cooperation with a rolis system in the village of Cibiru Hilir Cileunyi district Bandung regency and to know the legal review of Islamic economics on the implementation of business cooperation business stalls with rolis system in the village Cibiru Hilir district Cileunyi Bandung regency. This study is based on the idea that in the contract syirkah that is on each party contribute the fund (or charity) with the agreement that the profit and loss are shared together in accordance with the agreement. The method used in this research is the normative-empirical method that is the method of implementation of the normative law provisions in its action on every legal event occurring in society. Data collection techniques used are interviews and documentation. Then the data is studied, grouped, analyzed, and drawn a conclusion. The results of this study indicate that the implementation of business cooperation efforts store with rolis system in the village Cibiru Hilir district Cileunyi Bandung regency, is a collaboration with the purpose of obtaining benefits which in the management carried out in rotation, with a period of one to two months. Profit-making is not based on profit sharing, but on the basis of income during a turn to manage, and in the implementation there is no element that is prohibited syara, such as harming others, and injustice, as well as the members who cooperate very well with the system they run so no one feels harmed. ملخص متجر التقليدية هي واحدة من قطاعات الأعمال واعدة، لأنه هو جزء مهم للمجتمع الاندونيسي اليومي. بشكل عام، الأكشاك على شكل كشك، والمحلات التجارية، أو المحلات التجارية الصغيرة التي يملكها ويديرها فرد واحد، ولكن في تطويرها هناك بعض الأكشاك التي لا تملكها الأفراد فقط، والتي يمكن أن تكون مملوكة من قبل شخصين أو أكثر مع طريق التعاون . واحدة من الأعمال التجارية التقليدية متجر في قرية سيبيرو هيلير، منطقة سيليوني، باندونغ ريجنسي، وهو مشروع مشترك باستخدام نظام روليس، حيث كل واحد يستثمر نفس المبلغ الذي في إدارتها يستخدم نظام بالتناوب مع فترة من شهر واحد أو شهرين، وفي تحقيق الربح لا يستخدم نظام تقاسم الأرباح، ولكن الميزة المكتسبة عندما يحصل يحصل بدوره لإدارة. وتهدف هذه الدراسة إلى تحديد تنفيذ التعاون في مجال الأعمال مع نظام روليس في قرية سيبيرو هيلير سيليوني منطقة باندونغ ريجنسي ومعرفة المراجعة القانونية للاقتصاد الإسلامي على تنفيذ الأكشاك التجارية التعاون التجاري مع نظام روليس في قرية سيبيرو هيلير حي سيليوني باندونج ريجنسي. وتستند هذه الدراسة إلى فكرة أنه في العقد الذي يساهم كل طرف في الصندوق (أو المؤسسة الخيرية) مع الاتفاق على تقاسم الأرباح والخسائر معا وفقا للاتفاقية. والطريقة المستخدمة في هذا البحث هي الطريقة المعيارية التجريبية التي هي طريقة تنفيذ أحكام القانون المعياري في إجراءاته بشأن كل حدث قانوني يحدث في المجتمع. تقنيات جمع البيانات المستخدمة هي المقابلات والوثائق. ثم يتم دراسة البيانات، وتجميعها، وتحليلها، ورسم استنتاج. وتشير نتائج هذه الدراسة إلى أن تنفيذ جهود التعاون في مجال الأعمال التجارية متجر مع نظام روليس في قرية سيبيرو هيلير منطقة سيليوني باندونغ ريجنسي، هو التعاون مع الغرض من الحصول على الفوائد التي في إدارة نفذت في التناوب، مع فترة واحدة إلى شهرين. ولا يستند الربح إلى تقاسم الأرباح، ولكن على أساس الدخل أثناء منعطف لإدارة، وفي التنفيذ لا يوجد أي عنصر محظور محظورة، مثل الإضرار بالآخرين، والظلم، فضلا عن الأعضاء الذين يتعاونون بشكل جيد جدا مع النظام تشغيلها حتى لا يشعر أحد بأذى.
