Abstract

INDONESIA : Penyelenggaraan urusan pemerintahan bidang kehutanan, kelautan, serta energi sumber daya mineral dibagi antara pemerintah pusat dan daerah provinsi sebagaimana diamanatkan dalam undang-undang nomor 23 tahun 2014 pasal 14 ayat (1) dan (3) tentang pemerintah daerah, sehingga dengan peralihan fungsi pengawasan tambang dari Kabupaten Garut ke Provinsi Jawa barat menimbulkan maraknya perusahaan tambang galian c tanpa izin di Kecamatan Leles Kabupaten Garut. Penelitian ini bertujuan untuk menganalisis bagaimana pelaksanaan fungsi pengawasan, beserta efektivitas pengawasan yang telah dilaksanakan oleh Dinas energi dan sumber daya mineral provinsi Jawa barat terhadap aktivitas tambang galian c tanpa izin di kecamatan leles kabupaten Garut. Jenis penelitian yang digunakan deskriptif kualitatif, dengan pendekatan penelitian kualitatif untuk menganalisis fungsi pengawasan terhadap tambang galian c, sedangkan metode pengumpulan data yang digunakan dengan cara wawancara, observasi, dan dokumentasi. Adapun teknik analisis data yaitu dengan Reduksi data, Penyajian data, analisis dan kesimpulan. Penelitian ini menggunakan landasan teori utama (Grand Theory) Teori Otonomi Daerah. Untuk mendukung teori utama sebagai Middle Theory peneliti menggunakan Teori Kewenangan. Sedangkan untuk applied theory yang digunakan adalah teori Pengawasan dan Teori Efektivitas Hukum. Hasil penelitian menunjukkan bahwa fungsi pengawasan yang telah dilaksanakan oleh Dinas energi dan sumber daya mineral belum optimal, dikarenakan masih terdapat aktivitas tambang galian c tanpa izin di Kecamatan Leles Kabupaten Garut, hal ini mengindikasikan bahwa sistem pengawasan yang telah dilaksanakan belum mampu sepenuhnya mengendalikan kegiatan tambang galian c tanpa izin, sedangkan yang menjadi kendala dalam melaksanakan fungsi pengawasan, pertama tidak adanya kesadaran masyarakat dalam memahami dampak negatif yang ditimbulkan oleh aktivitas tambang galian c tanpa izin, yang kedua jarak tempuh dalam melaksanakan pengawasan antara pemerintah daerah provinsi dengan lokasi tambang galian c yang sangat jauh, yang ketiga belum adanya kebijakan khusus yang dibuat oleh Dinas energi dan sumber daya mineral Provinsi Jawa barat tentang Tindak Lanjut Hasil Pengawasan, dengan menetapkan batasan waktu untuk menyelesaikan Tindak Lanjut Hasil pengawasan. ENGLISH : The implementation of government affairs in the fields of forestry, maritime affairs, and energy and mineral resources is divided between the central government and the provincial regions as mandated in law number 23 of 2014 article 14 paragraph (1) and (3) concerning regional governments, the impact of the shift in the mining supervisory function from Garut Regency to West Java Province gave rise to the rise of unlicensed mining c mining companies in Leles District, Garut Regency. This study aims to analyze how the implementation of the supervisory function, along with the effectiveness of the supervision that has been carried out by the Department of Energy and Mineral Resources of West Java province on unlicensed excavation c mining activities in Leles sub-district, Garut regency. The type of research used is descriptive qualitative which studies case studies, with a qualitative research approach to analyze the supervisory function of excavation c. while the data collection method used by way of interviews, observation, and documentation. The data analysis technique is data reduction, data presentation, analysis and conclusions. In this study, the main theoretical foundation (Grand Theory) in research is the Theory of the Unitary State, to support the main theory as a Middle Theory the researcher uses the Theory of Regional Autonomy and Decentralization while for the applied theory the theory of Supervision is used. The results of the study show that the supervisory function that has been carried out by the Department of Energy and Mineral Resources is not optimal, because there are still unlicensed mining activities c in the Leles sub-district, Garut regency, this indicates that the monitoring system that has been implemented has not been able to fully control excavation mining activities. c without a permit, while the obstacles in carrying out the supervisory function, firstly there is no public awareness in understanding the negative impacts caused by mining activities c without a permit, the second is the distance in carrying out supervision between the provincial government and the mining location c which is very far, the third is that there has been no specific policy made by the Department of energy and mineral resources of West Java Province regarding Follow-Up of Supervision Results, by setting a time limit for completing the Follow-Up of supervision results.
