Abstract

ENGLISH : This research is motivated by the problem of Beneficiary Families (KPM This research is motivated by Permensos No. 1 of 2018 Article 7 on the Family Hope Program (PKH) which explains that KPM PKH's obligations related to the allocation of social assistance funds are intended to meet education, health, and social welfare. The article is in fact the beneficiary's family (KPM) does not use the right to social assistance in accordance with its designation and also does not carry out its obligations as a recipient of PKH social assistance. The CCT Program also refers to the principle of legal expediency where by looking at whether a particular policy or action brings benefits or useful results or, conversely, losses for the people concerned. The purpose of this study was to determine and analyze the implementation of the Family Hope Program (PKH) social assistance related to Permensos Number 01 of 2018 and the principle of legal benefit in Bandung Regency. Knowing and analyzing the constraints faced by the Social Service of Bandung regency related to Social Assistance Program family hope (PKH) in Bandung Regency. Knowing and analyzing the efforts of the Social Service of Bandung Regency in overcoming obstacles to Social Assistance Program family hope (PKH) in Bandung Regency. The research method used is descriptive analysis method that uses empirical juridical approach with qualitative research. This research uses the framework of which is the theory of legal objectives as a grand theory that discusses equal rights in accordance with the proposition, the middle theory used is the theory of social welfare because this problem is related to the welfare of the community or KPM recipients of social assistance, and applied theory using the theory of legal effectiveness because there is a relationship between rights and obligations for recipients of social assistance. The results of the PKH implementation research are linked to Permensos Number 1 of 2018 and the principle of legal benefit is less significant felt by program recipients, there are still some KPM who receive assistance that does not match their rights, and also does not carry out their obligations properly, KPM who guarantees or does not use KKS as it should will be, the companion must cooperate with various parties. Efforts related to increasing the ratio of assistance must be further improved for the success and implementation of superior CCT programs. INDONESIA : Penelitian ini dilatarbelakangi oleh Permensos Nomor 1 tahun 2018 Pasal 7 tentang Program Keluarga Harapan (PKH) yang menjelaskan bahwa kewajiban KPM PKH terkait alokasi dana bantuan sosial diperuntukkan untuk memenuhi pendidikan, kesehatan, dan kesejahteraan sosial. Pasal tersebut dalam faktanya Keluarga Penerima Manfaat (KPM) tidak menggunakan hak bantuan sosial sesuai dengan peruntukannya dan juga tidak melaksanakan kewajibannya sebagai penerima bantuan sosial PKH. Program PKH pun mengacu pada Asas Kemanfaatan Hukum di mana dengan melihat apakah suatu kebijakan atau tindakan tertentu membawa manfaat atau hasil yang berguna atau, sebaliknya kerugian bagi orang-orang yang terkait. Tujuan Penelitian ini adalah untuk mengetahui dan menganalisis Implementasi Bantuan Sosial Program Keluarga Harapan (PKH) dihubungkan dengan Permensos Nomor 01 Tahun 2018 dan Asas kemanfaatan Hukum di Kabupaten Bandung. Mengetahui dan menganalisis kendala yang dihadapi Dinas Sosial Kabupaten Bandung terkait dengan Bantuan Sosial Program Keluarga Harapan (PKH) di Kabupaten Bandung. Mengetahui dan menganalisis upaya Dinas Sosial Kabupaten Bandung dalam mengatasi kendala Bantuan Sosial Program Keluarga Harapan (PKH) di Kabupaten Bandung. Metode Penelitian yang digunakan adalah metode deskriptif analisis yakni menggunakan pendekatan yuridis empiris dengan jenis Penelitian kualitatif. Penelitian ini menggunakan kerangka pemikiran diantaranya adalah teori Tujuan Hukum sebagai grand theory yang membahas persamaan hak sesuai dengan proposionalnya, middle theory yang digunakan adalah teori kesejahteraan sosial karena permasalahan ini berkaitan dengan kesejahteraan masyarakat atau KPM penerima bantuan sosial PKH, serta applied theory menggunakan teori efektivitas hukum karena terdapat hubungan antara hak dan kewajiban bagi penerima bantuan sosial PKH. Hasil Penelitian Implementasi PKH dihubungkan dengan Permensos Nomor 1 Tahun 2018 dan Asas Kemanfaatan Hukum kurang signifikan dirasakan oleh penerima program, masih terdapat beberapa KPM yang menerima bantuan tidak sesuai hak nya, dan juga tidak melaksanakan kewajibannya dengan baik, KPM yang menjaminkan atau tidak mempergunakan KKS sebagaimana mestinya akan dikenakan sanksi secara tegas dan sanksi tersebut dituliskan di Permensos Nomor 1 Tahun 2018, KPM yang tidak melaksanakan kewajiban P2K2 pun sebaiknya ada sanksi tegas karena bantuan sosial PKH ini bersyarat, pendamping harus bekerjasama dengan berbagai pihak. Upaya terkait dengan peningkatan rasio dampingan pendamping pun harus lebih ditingkatkan demi sukses dan terlaksananya program PKH yang unggul.
