Abstract
Penelitian ini menganalisis penerapan konsep Hybrid Contracts dalam operasional transaksi Letter of Credit L/C Perdagangan Internasional di Bank Muamalat Indonesia. Dengan latar belakang pentingnya perdagangan internasional dalam perekonomian global, terutama dalam pembiayaan perdagangan dan instrumen pembayaran, konsep Hybrid Contracts muncul sebagai alternatif yang relevan. Melalui metode kualitatif dengan pendekatan yuridis menggunakan analisis studi pustaka yang relevan, penelitian ini menyoroti peran dan tantangan lembaga keuangan syariah dalam inovasi produk. Hasil penelitian ini menjelaskan bahwa Bank Muamalat Indonesia menggunakan dua jenis akad, yakni Wakâlah bil Ujrah dan Akad Murâbahah dalam operasional transaksi L/C Ekspor-Impor, dengan penekanan pada kontrak L/C dan dokumen terkait. Analisis operasional transaksi L/C di Bank Muamalat Indonesia mencakup faktor keberadaan syariah, manajemen risiko, efisiensi operasional, dan pelayanan pelanggan. Namun, ada tantangan terkait penentuan ujrah dalam bentuk nominal yang sejalan dengan Fatwa DSN MUI. Skema operasional transaksi L/C diuraikan melalui langkah-langkah kunci, termasuk penanganan dokumen, pembayaran, dan pengaturan biaya administrasi. Penelitian ini mendukung kebijakan DSN MUI yang mendorong keterbukaan dan perlindungan terhadap kepentingan importir dalam transaksi perdagangan internasional, sambil memastikan kepatuhan terhadap prinsip-prinsip syariah. This research analyzes the application of the Hybrid Contracts concept in the operations of International Trade Letter of Credit L/C transactions at Bank Muamalat Indonesia. Against the background of the importance of international trade in the global economy, especially in trade financing and payment instruments, the concept of Hybrid Contracts emerges as a relevant alternative. Through qualitative methods with a juridical approach using analysis of relevant literature studies, this research highlights the role and challenges of Islamic financial institutions in product innovation. The results of this research explain that Bank Muamalat Indonesia uses two types of contracts, namely Wakâlah bil Ujrah and Murâbahah contracts in its ExportImport L/C transaction operations, with an emphasis on L/C and documents. Operational analysis of L/C transactions at Bank Muamalat Indonesia includes sharia factors, risk management, operational efficiency and customer service. However, there are challenges related to determining ujrah in nominal form which is in line with the MUI DSN Fatwa. The operational scheme of L/C transactions is outlined through key steps, including document handling, payment, and administration fee arrangements. This research supports the MUI DSN policy which encourages openness and protection of importers' interests in international trade transactions, while ensuring compliance with sharia principles.
