Abstract

INDONESIA: Praktik pengupahan terkait buruh kayu gelonggongan sudah cukup lama dilakukan, tepatnya di Desa Siderang Kecamatan Cigedug Kabupaten Garut, dimana dalam praktiknya para buruh akan mengangkut kayu gelonggongan satu persatu yang mana nantinya ketika selesai dalam satu hari maka akan diberikan upah. Namun dalam praktik pemberian upah tersebut terdapat penundaan pembayaran, adanya rasa ketidakadilan yang dirasakan oleh para buruh dari pemberi kerja serta adanya kesepakatan yang sudah disepakati di awal namun berbeda pada saat praktiknya. Penelitian ini bertujuan untuk: (1) mengetahui praktik pengupahan buruh kayu gelonggongan Di Desa Siderang Kecamatan Cigedug Kabupaten Garut; serta (2) untuk mengetahui konsep hukum Islam serta implikasinya terhadap pengupahan buruh kayu gelonggongan (3) untuk mengetahui implementasi Fiqh Ijarah dalam praktik pengupahan buruh kayu gelonggongan. Pendekatan yang digunakan penulis dalam penelitian adalah pendekatan kualitatif yang menjelaskan suatu fenomena dengan mendalam disajikan bukan dalam bentuk bilangan melainkan berupa kata-kata yang tentunya mengandung makna yang berkaitan dengan topik penelitian serta metode yang digunakan penulis dalam penelitian ini ialah metode deskriftif analisis yang bertujuan mendeskripsikan atau menggambarkan keadaan atau fenomena yang terjadi di masyarakat tentunya Di Desa Siderang Kecamatan Cigedug Kabupaten Garut yang akan menjadi tempat/lokasi penelitian. Hasil penelitian ini menunjukan bahwa: Praktik pengupahan buruh kayu gelonggongan Di Desa Siderang Kecamatan Cigedug Kabupaten Garut dilakukan secara langsung terkait upah atau ujrah yang diberikan sebesar Rp 45.000 untuk satu orangnya. Upah tersebut diberikan setelah selesai bekerja secara langsung. Konsep Hukum Islam serta implikasinya dalam pengupahan buruh kayu gelonggongan ternyata tidak sesuai dengan asas-asas serta prinsip yang menjadi dasar dalam pengupahan dalam hukum Islam, begitu juga dengan implementasi Fiqh Ijarah yang tidak diterapkan dalam pengupahan buruh kayu gelonggongan. ENGLISH: The practice of wages related to log workers has been in place for quite a long time, specifically in Siderang Village, Cigedug District, Garut Regency, where in practice the workers will transport logs one by one and when they are finished in one day they will be given wages. However, in the practice of paying wages, there are delays in payment, there is a sense of injustice felt by workers from their employers and there are agreements that have been agreed at the start but are different in practice. This research aims to: (1) determine the wage practices of log workers in Siderang Village, Cigedug District, Garut Regency; and (2) to understand the concept of Islamic law and its implications for the wages of log workers (3) to find out the implementation of Fiqh Ijarah in the practice of wages of log workers The approach used by the author in research is a qualitative approach which explains a phenomenon in depth, presented not in the form of numbers but in the form of words which of course contain meaning related to the research topic and the method used by the author in this research is a descriptive method of analysis which aims to describe or describe the conditions or phenomena that occur in society, of course in Siderang Village, Cigedug District, Garut Regency which will be the research place/location. The results of this research show that: The practice of wages for log workers in Siderang Village, Cigedug District, Garut Regency is carried out directly in relation to the wages or ujrah given in the amount of IDR 45,000 for one person. The wages are given after completing work directly. The concept of Islamic Law and its implications in the wages of log workers are apparently not in accordance with the principles and principles that form the basis of wages in Islamic law, as well as the implementation of Fiqh Ijarah which is not applied in the wages of log workers.
