Abstract

INDONESIA: Penelitian ini dilatarbelakangi oleh kesenjangan pemahaman tekstual Q.S an-Nisa ayat 3 mengenai keadilan dalam poligami dan korelasi pada UU Pernikahan No 1 tahun 1974 serta pengaplikasian dalam kehidupan masyarakat. Praktik poligami selalu menjadi isu yang hangat dibicarakan di kalangan masyarakat Indonesia, adil merupakan syarat utama bagi seorang suami yang ingin berpoligami. Penelitian ini fokus pada penafsiran Hasbi Ash-Shiddiqi pada Tafsir An-Nur dan Quraish Shihab pada Tafsir Al-Mishbah mengenai konsep ‘adl dalam poligami pada Q.S An-Nisa ayat 3 dan korelasinya terhadap UU Pernikahan No 1 Tahun 1974. Tujuan dari penelitian ini (1) untuk mengetahui makna ‘adl dalam Q.S An-Nisa ayat 3 prespektif penafsiran Hasbi Ash-Shiddiqi pada Tafsir An-Nur dan Quraish Shihab pada Tafsir al-Mishbah, (2). Untuk mengetahui perbedaan dan persamaan penafsiran makna ‘adl dalam Q.S An-Nisa ayat 3 prespektif penafsiran Hasbi Ash-Shiddiqi pada Tafsir An-Nur dan Quraish Shihab pada Tafsir al-Mishbah, serta hal yang melatarbelakangi perbedaan kedua penafsiran. (3). Untuk mengetahui korelasi penafsiran Q.S An-Nisa ayat 3 dan meninjau kembali terhadap UU Perkawinan pasal 1 tahun 1974 dan dampaknya. Signifikansi penelitian ini terletak pada kontribusinya dalam memperkaya khazanah ilmu tafsir dan pemahaman konsep adl dalam poligami pada kehidupan modern. Penelitian inimenggunakan pendekatan kualitatif dengan teknik pengumpulan data studi kepustakaan. Data utama diambil dari Tafsir An-Nur dan Tafsir al-Mishbah,sementara data sekunder diperoleh dari buku-buku, artikel jurnal dan penelitian-penelitian terkait adil dalam poligami. Metode analisis yang digunakan adalah content analysis dengan kerangka teori yang mengintegrasikan konsep keadilan dan teori tafsir muqaran Syeikh Raudhah Abdul Karim. Hasil penelitian menunjukkan bahwa adanya perbedaan penafsiran antara Hasbi Ash-Shiddiqi dan Quraish Shihab pada Q.S An-Nisa ayat 3 dalam permasalahan adil poligami, perbedaan tersebut dalam hal perbedaan pemaknaan kata al’adl dan al-qist, perbedaan barometer keadilan dalam poligami, perbedaan metode tafsir, perbedaan corak tafsir. perbedaan tersebut dilatarbelakangi oleh sosial-historis dan konteks zaman. Korelasi penafsiran Quraish dan Hasbi yaitu dalam keadilan gender. Peneliti selanjutnya dapat mengeksplorasi penafsiran mengenai keadilan dalam poligami menurut mufasir lain. ENGLISH: This study is motivated by the gap in textual understanding of Q.S. An-Nisa verse 3 regarding justice in polygamy and its correlation with the Marriage Law No. 1 of 1974, as well as its application in societal life. The practice of polygamy continues to be a heated issue in Indonesian society, where justice is the main requirement for a husband wishing to practice polygamy. This research focuses on the interpretations of Hasbi Ash-Shiddiqi in Tafsir An-Nur and Tafsir al-Mishbah by Quraish Shihab concerning the concept of ‘adl (justice) in polygamy in Q.S. An-Nisa verse 3 and its relevance to the Marriage Law No. 1 of 1974. The objectives of this research are: (1) to explore the meaning of ‘adl in Q.S. An-Nisa verse 3 from the perspectives of Hasbi Ash-Shiddiqi in Tafsir An-Nur and Quraish Shihab in Tafsir al-Mishbah; (2) to identify the background behind the similarities and differences in their interpretations of ‘adl in Q.S. An-Nisa verse 3; and (3) to examine the correlation between their interpretations and the Marriage Law No. 1 of 1974, as well as its impact. The significance of this research lies in its contribution to enriching the discourse of Qur’anic exegesis and the understanding of the concept of justice in polygamy in modern life. This study employs a qualitative approach using library research methods. The primary data sources are Tafsir An-Nur and Tafsir al-Mishbah, while secondary data are obtained from books, journal articles, and related research on justice in polygamy. The analysis method used is content analysis with a theoretical framework that integrates the concept of justice and the theory of tafsir muqaran by Sheikh Raudhah Abdul Karim. The findings show that there are differences in the interpretation of Q.S. An-Nisa verse 3 between Hasbi Ash-Shiddiqi and Quraish Shihab on the issue of justice in polygamy. These differences are seen in the interpretation of the terms al-‘adl and al-qist, in the standards of justice in polygamy, in the methods of interpretation, and in their respective exegetical styles. These differences are influenced by socio-historical backgrounds and contextual time periods. However, both interpretations share a correlation in emphasizing gender justice. Future researchers are encouraged to further explore interpretations of justice in polygamy from other exegetes. ARABIC: البحث هذا نابع من الفجوة في الفهم النصي للآية الثالثة من سورة النساء بشأن العدالة في التعدد، وعلاقته بقانون الزواج رقم 1 لسنة 1974 وتطبيقه في حياة المجتمع. فمسألة التعدد لا تزال من القضايا المثيرة للجدل في المجتمع الإندونيسي، حيث يُعتبر العدل شرطًا أساسيًا للرجل الراغب في التعدد. يركز هذا البحث على تفسير حسبي الصديقي في تفسير النور، وتفسير قريش شهاب في تفسير المصباح، فيما يتعلق بمفهوم العدل في التعدد في الآية الثالثة من سورة النساء، وعلاقته بقانون الزواج رقم 1 لسنة 1974. ويهدف هذا البحث إلى: (1) معرفة معنى العدل في الآية 3 من سورة النساء من وجهة نظر تفسير حسبي الصديقي في تفسير النور، وقريش شهاب في تفسير المصباح؛ (2) معرفة أوجه التشابه والاختلاف في تفسير معنى العدل في الآية من وجهة نظر التفسيرين، والأسباب الكامنة وراء هذه الاختلافات؛ (3) معرفة العلاقة بين تفسير الآية 3 من سورة النساء وإعادة النظر في قانون الزواج الإندونيسي رقم 1 لسنة 1974 وآثاره. وتكمن أهمية هذا البحث في إسهامه في إثراء مجال التفسير وفهم مفهوم العدل في التعدد ضمن الحياة المعاصرة. ويعتمد هذا البحث على المنهج النوعي، باستخدام تقنية جمع البيانات من خلال الدراسة المكتبية. وتتمثل المصادر الأساسية في تفسير النور وتفسير المصباح، بينما تشمل المصادر الثانوية الكتب، والمقالات العلمية، والدراسات المتعلقة بالعدالة في التعدد. أما المنهج التحليلي المستخدم فهو تحليل المحتوى، بإطار نظري يجمع بين مفهوم العدالة ونظرية التفسير المقارن للشيخ روضة عبد الكريم. وأظهرت نتائج البحث وجود اختلاف في تفسير الآية 3 من سورة النساء بين حسبي الصديقي وقريش شهاب فيما يتعلق بمسألة العدل في التعدد، ويكمن هذا الاختلاف في: اختلاف في تفسير كلمتي العدل والقسط، اختلاف في معيار العدالة في التعدد، اختلاف في منهج التفسير، واختلاف في اتجاه التفسير. وترجع هذه الاختلافات إلى السياق الاجتماعي والتاريخي والزماني. أما العلاقة بين تفسير قريش شهاب وحسبي الصديقي فتتمثل في العدالة الجندرية.
