Abstract

Teknologi terus dikembangkan dalam rangka mempermudah manusia melakukan aktifitasnya sehari-hari. Salah satu produk teknologi informasi dan komunikasi yang berkembang pesat saat ini adalah Internet. dunia internet telah memunculkan kejahahatan baru yaitu kejahatan cyber crime. kejahatan tindak pidana cyber crime dapat dilakukan tanpa mengenal batas teritorial dan tidak diperlukan interaksi langsung antara pelaku dengan korban kejahatan. Polda Jawa Barat kesulitan dalam menyelidiki pelaku tindak kejahatan cyeber crime. Sepanjang 2017, dari 78 laporan yang masuk hanya setengahnya yang pemberkasannya selesai atau P21. banyak kasus cyber crime yang tidak selesai di Polda Jawa Barat di karenakan kendala-kendala teknis, sehingga penulis mengunakan Perkap Nomor 14 Tahun 2012 Pasal 12 untuk mengetahui kendala-kendala yang terjadi dalam penyelesaian tindak pidana cyber crime. Tujuan dari penelitian tesis ini adalah untuk mengetahui tentang Proses penyelidikan tindak pidana cyber crime di Polda Jawa Barat dihubungkan dengan Perkap Nomor 14 tahun 2012 tentang manajemen penyidikan tindak Pidana Pasal 12, untuk mengetahui Kendala yang terjadi dalam Proses Penyelidikan tindak Pidana cyber crime di Polda Jawa Barat yang dihubungkan dengan Pekap Nomor 14 tahun 2012 Pasal 12, untuk mengetahui Upaya yang dapat lakukan untuk mengatasi kendala yang terjadi dalam proses Penyelidikan Tindak Pidana cyber crime di Polda Jawa Barat. Teori yang di gunakan dalam tesis ini adalah teori Roscoe Pound tentang keseimbangan Kepentingan yang mana menyeimbangkan kepentian kepolisian dan masyarakat. teori yang berikutnya adalah teori reltif berpangkal pada dasar bahwa pidana adalah alat untuk menegakan tata tertib (hukum) dalam masyarakat, dan teori yang terakhir adalah teori negara hukum ialah negara yang berediri di atas hukum yang menjamin keadilan kepada warga negaranya. Metode Penelitian yang di gunakan bersifat Penelitian Lapangan dengan Pendekatan Yuridis Empiris. Teknik pengumpulan data yang digunakan adalah wawancara dan studi kepustakaan, jenis data yang digunakan dalam penelitian ini adalah data primer yang terdiri dari Undang-undang dan data sekunder yang terdiri dari berbagai macam bahan bacaan yang terkait dengan judul penelitian seperti buku-buku mengenai tindak pidana cyber crime, artikel-artikel, jurnal-jurnal serta literature. Hasil penelitian tesis ini menjelaskan bahwa proses penyidikan tindak pidana cyber crime di Polda Jawa Barat mengunakan Perkap No 14 Tahun 2012 pada pasal 12 terdiri dari pengolahan TKP, pengamatan (observasi), wawancara (interview), pembuntutan (surveillance), penyamaran (under cover), pelacakan (tracking), penelitian dan analisis dokumen Namun banyak kendala-kendala yang menjadi penghambat dalam proses penyidikan ini seperti kekurangan sumber daya manusia, kekurangan sarana dan prasarana serta anggaran yang tidak memadai dari kendala tersebut ada beberapa upaya yang bisa di lakukan yakni anggota polisi unit cyber crime di tambah, sarana dan prasarana pendukung seperti laboratorium dan komputer di fasilitasi serta untuk anggaran perkasusnya di perbesar lagi sehingga untuk proses penyelidikan berjalan dengan baik. Technology continues to be developed in order to make it easier for humans to carry out their daily activities. One of the fastest growing information and communication technology products today is the Internet. the world of the internet has created a new evil that is cyber crime. Cybercrime crimes can be committed without knowing territorial boundaries and no direct interaction between the perpetrators and the victims of crime is needed. West Java Regional Police have difficulty investigating the perpetrators of cyber crime. Throughout 2017, only half of the 78 reports entered were completed or P21. many cases of cyber crime that were not completed in the West Java Regional Police were due to technical constraints, so the author used Perkap No. 14 of 2012 Article 12 to find out the obstacles that occur in the settlement of cyber crime The purpose of this thesis research is to find out about the investigation process of cyber crime in the West Java Regional Police, connected with Perkap No. 14 of 2012 concerning the management of Article 12 criminal investigation, to find out the obstacles that occur in the process of investigating cyber crime in the West Java Regional Police connected with Pekap Number 14 of 2012 Article 12, to find out the efforts that can be done to overcome the obstacles that occur in the process of investigating cyber crime in the West Java Regional Police. The theory used in this thesis is Roscoe Pound's theory of the balance of interests which balances the cessation of the police and society. the next theory is relative theory based on the basis that criminal is a tool to enforce the law (law) in society, and the last theory is the theory of the rule of law is a country that has a law that guarantees justice to its citizens. The research method used is Field Research with an Empirical Juridical Approach. Data collection techniques used are interviews and literature studies, the type of data used in this study is primary data consisting of laws and secondary data consisting of various kinds of reading material related to research titles such as books on cyber crime crime, articles, journals and literature The results of this thesis study explain that the process of investigating cyber crime in the West Java Regional Police using Perkap No. 14 of 2012 in article 12 consists of processing crime scenes, observations, interviews, surveillance, disguises (under cover) , tracking (tracking), research and document analysis. However, many obstacles that become obstacles in the investigation process such as lack of human resources, lack of facilities and infrastructure and inadequate budget from these constraints are some efforts that can be done, namely police officers Cyber crime units are added, supporting facilities and infrastructure such as laboratories and computers are facilitated as well as for enlarging the per capus budget so that the investigation process goes well.
