Abstract
Perlindungan terhadap anak dewasa ini belum dapat terwujud secara maksimal baik ketika anak berada dilingkungan keluarganya, masyarakat ataupun dalam lingkungan pendidikan/sekolah. Surv ei yang dilakukan Komisi Perlindungan Anak Indonesia (KPAI), menunjukkan sepanjang tahun 2012, tingka tkekerasan di sekolah mencapai 87,6persen. Sesuai dengan bidang yang dikaji penelitian ini adalah penelitian deskriptif analitis. Melalui penelitian ini diharapkan dapat memperoleh gambaran yang jelas mengenai tindak kekerasan yang dilakukan guru terhadap siswa dilingkungan sekolah.Penelitian ini dilakukan dengan menggunakan pendekatan yuridis normatif. Pemilihan metode pendekatan ini dengan dasar bahwa penelitian ini ditujukan untuk mengkaji norma-norma hukum yang berlaku terutama dalam hal tindak kekerasan guru terhadap siswa dilingkungan sekolah. Hasil penelitian menunjukan pemberian sanksi yang dilakukan pendidik terhadap peserta didik di lingkungan pendidikan termasuk kategori tindak kekerasan jika pemberian sanksi tersebut melukai dan atau mencederai anak dan tidak semata-mata fisik, tetapi juga mental dan sosial. memberikan kewenangan kepada guru untuk memberikan sanksi kepada siswa yang dianggap melanggar peraturan sekolah. Upaya yang dapat dilakukan untuk untuk mengatasi terjadinya tindak kekerasan guru terhadap siswa meliputi pengembangan pemahaman dan kesadaran tentang hak dan perlindungan anak di kalangan pendidik, merumuskan mekanisme yang mengatur berbagai kegiatan yang ada di sekolah, serta mewujudkan dan menegakan supremasi hukum dalam perlindungan anak. Direkomendasikan hendaknya pihak-pihak yang berwenang memasukan substansi Hak Asasi Manusia ke dalam kurikulum pendidikan, penegak hukum yang adil dan tegas terhadap pelaku tindak kekerasan anak sesuai Undang-Undang At this time, Children protection can not be realized very maximal whether when they are in environment of their family, society and education. Based on the results of research conducted by UNICEF (2006) in several regions in Indonesia showed about 80% of the violence carried out by teachers on students. In fact teachers should be as second parents at school, should be the ones who are able to create a cozyat mosphere and create school as a place that has the most secure and trusted for the child. Survey conducted by Indonesian Child Protection Commission (KPAI), suggests on 2012, the level of violence at schools reached 87.6 percent. This study aims to describe how the law of constitution number 17, 2016 on Child Protection, explains the limitation of giving sanctions undertaken by educators at school environment for the students and explains what efforts can be made to address teacher’s act violence against learners, and Government regulations number 19,2017 on Teachers. The study of this research is a descriptive analysis. This research is expected to obtain a clear description of the teachers’ violence perpetrated against students within the education in the criminal justice system in Indonesia. This research was conducted using the normative juridical approach. Selection of this approach on the basis that this study seeks to examine the legal norms in force, especially in the case of teachers’ violence against learners in environmental education. The results showed that the law number 17 Year 2016 on child protection explicitly states that the children at school environment must be protected from acts of violence committed by teachers, school administrators, friends at school, and other educational institution.The constitution states any person who commits cruelty, violence or threats of violence, or child abuse, punished by imprisonment or fines. Similarly if there are sanctions given by educators on learners in an educational environment will be included as category of violence if the sanctions hurt or injure the child not merely physical but also mental and social,but the govermen regulations number 19 of 2017 concerning teacher, provinding authority to teacher to sanction students who are considered violating school regulations. Efforts should be made to tackle teachers’ act violence by giving the development of learners' understanding and awareness about the rights and protection of children, the formulation of mechanisms that regulate a variety of activities at school, realization on how to uphold the rule of law in the protection of children.recommended that parties should be authorized to include the substance of human rights into curriculum and fairness on law enforcement against perpetrators of child abuse according to constitution and the development of the child friendly school.
