Abstract
INDONESIA : Perkembangan Artificial Intelligence (AI) memengaruhi proses penciptaan karya tulis, khususnya dalam kegiatan penyusunan, penyuntingan, dan pengolahan teks. Namun Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta belum mengatur secara eksplisit status subjek hukum atas karya tulis berbasis AI, khususnya terkait subjek hukum pemegang hak ekonomi sebagaimana diatur dalam Pasal 9. Ketiadaan pengaturan khusus tersebut menimbulkan ketidakpastian hukum mengenai kedudukan pencipta, lahir atau tidaknya hak ekonomi, serta pengelolaan dan penegakan hak ekonomi atas karya tulis yang melibatkan AI. Penelitian ini bertujuan menganalisis pengaturan hukum hak ekonomi berdasarkan UU Hak Cipta, akibat hukum dari pemanfaatan karya tulis berbasis AI, serta indikator konkret dalam mengukur sejauh mana kontribusi manusia. Metode penelitian yang digunakan adalah penelitian hukum yuridis normatif dengan pendekatan perundang-undangan, doktrin hukum dan pendekatan komparatif, yang diperkuat dengan data wawancara kepada Divisi Kekayaan Intelektual Kemenkum Jabar. Hasil penelitian menunjukkan bahwa pengaturan UU Hak Cipta pada pasal 9 belum mampu mewadahi hak ekonomi karya tulis berbasis kecerdasan buatan dan hanya diakui apabila terdapat kontribusi kreatif manusia yang dapat dibuktikan, sementara ketiadaan parameter yang jelas menimbulkan kesulitan pembuktian, berakibat hukum pada ketidakpastian pemegang hak ekonomi, ketidakpastian penarikan serta pengelolaan royalti, ketidakpastian hak distribusi, dan timbulnya sengketa pada hak ekonomi. ENGLISH : The development of artificial intelligence (AI) affects the process of creating written works, particularly in the activities of drafting, editing, and processing text. However, Law Number 28 of 2014 concerning Copyright does not explicitly regulate the legal status of AI-generated written works, particularly with regard to the legal entity holding the economic rights as set out in Article 9. The absence of specific regulations has led to legal uncertainty regarding the position of creators, the existence or non-existence of economic rights, and the management and enforcement of economic rights over written works involving AI. This study aims to analyze the legal regulation of economic rights under the Copyright Law, the legal implications of the use of AI-generated written works, and concrete indicators for measuring the extent of human contribution. The research employs a normative juridical method with a statutory approach, legal doctrine and a comparative approach, supported by interview data from the Intellectual Property Division of the Regional Office of the Ministry of Law and Human Rights of West Java. The results indicate that Article 9 of the Copyright Law has not adequately accommodated the economic rights of AI based written works and that such rights are only recognized when there is provable human creative contribution. Meanwhile, the absence of clear parameters creates difficulties in evidentiary processes, leading to legal consequences in the form of uncertainty regarding the holders of economic rights, the collection and management of royalties, distribution rights, and the emergence of disputes over economic rights.
