Abstract

INDONESIA Praktek pengupahan di kelompok pertambangan emas yang berada di Desa Kertajaya Kecamatan Simpenan Kabupaten Sukabumi merupakan praktek pengupahan dengan menggunakan batu tambang yang mengandung emas sebagai upahnya. Batu tersebut merupakan batu hasil dari galian yang mereka dapatkan dari lubang-lubang yang mereka buat dari jenis tanah yang mngandung unsur emas. Penelitian ini bertujuan untuk mengetahui bagaimana norma pengupahan terhadap pegawai pertambangan emas di Desa Kertajaya kemudian bagaimana sistem pengupahan terhadap pegawai pertambangan emas di Desa Kerajaya Kecamatan Simpenan Kabupaten Sukabumi, serta untuk mengetahui bagaimna tinjauan hukum ekonomi syariah terhadap sistem pengupahan dan relasinya dengan norma pengupahan dalam hukum ekonomi syariah. Penelitian ini bertolak ukur pada pemikiran bahwa pada prinsipnya segala macam bentuk muamalah adalah boleh sampai ada dalil yang mengharamkannya atau membatalkannya. Disamping itu juga penelitian ini juga bertolak ukur dari kaidah yang menyatakan bahwa kemadharatan harus di hilangkan, sesmentara hukum islam merupakan hukum dapat menyesuaikan zaman dan situasi. Metode penelitian yang diterapkan adalah metode Deskriptif dengan jenis data Kualitatif. Teknik pengumpulan data dilakukan dengan observasi, wawncara dan studi kepustakaan. Adapun analisa yang yang digunakan merujuk kepada hasil wawancara dengan pihak yang bersangkutan yaitu para pekerja dan pemilik pertambangan emas. Hasil penelitian ini, dapat disimpulkan bahwa 1) norma pengupahan di kelompok pertambangan emas Desa Kertajaya Kecamatan Simpenan Kabupaten Sukabumi mengacu pada adanya faktor kebiasaan atau tradisi (urf), faktor-faktor ekonomi, saling percaya antara pemilik pertambangan dengan pegawainya. 2) sistem yang di terapkan di kelompok pertambanagan tersebut adalah sistem upah jangka waktu dengan pembayaran upah menggunakan batu yang mengandung kadar emas hasil dari pertambanagan yang mereka kerjakan, namun dalam hal ini penulis menemukan adanya unsur ketidak adilan yang disebabkan dari perbedaan kadar emas yang terdapat di setiap karung yang menjadi upah mereka, karena kemungkinan besar batu tambang tersebut tidak semua mengandung kadar emas yang sama persis dari setiap karungnya, yang menyebabkan salah satu pihak akan ada yang di rugikan. Dan 3) dilihat dari relasi diantara keduanya yaitu penerapan sistem dan norma pengupahan yang terjadi di kelompok pertambanagan tersebut, masih banyak yang tidak berbanding lurus atau tidak sesuai dengan aturan hukum syara’ terlebih dari sistem upah yang mereka gunakan, karena kurangnya pemahaman konsep atau aturan pengupahan yang telah di tetapkan hukum Islam, artinya relasi anatara sistem dan norma pengupahan yang terjadi di kelompok pertambangan tersebut masih banyak yang tidak sesuai. Kata kunci, Norma, Upah-mengupah, Hukum Ekonmoi Islam ENGLISH Wages in the gold mining group in Kertajaya Village, Simpenan Subdistrict, Sukabumi Regency are remuneration practices using quarry stones containing gold as their wages. The stone is the result of the excavation they got from the holes they made from the type of soil containing the gold element. This study aims to find out how wage norms for gold mining employees in Kertajaya Village then how the wage system for gold mining employees in Kerajaya Village Simpenan District, Sukabumi Regency, and to find out how to review Islamic economic law on wage systems and their relation to wage norms in economic law sharia. This research is based on the idea that in principle all forms of muamalah are permissible until there is a proposition that forbids them or cancels them. Besides that, this research is also a measure of the principle which states that kemadharatan must be eliminated, while Islamic law is a law that can adjust the times and situations. The research method applied is descriptive method with qualitative data types. Data collection techniques are carried out by observation, interviews and literature studies. The analysis used refers to the results of interviews with the parties concerned, namely workers and owners of gold mining.The results of this study, it can be concluded that 1) wage norms in the gold mining group of Kertajaya Village, Simpenan District, Sukabumi Regency refers to the existence of a factor of customs (urf), economic factors, mutual trust between mining owners and their employees. 2) the system applied in the mining group is a period of wage system with payment of wages using stones containing gold content as a result of the mining they are working on, but in this case the author finds an element of injustice caused by differences in the levels of gold found in each sack is their reward, because most likely the stone mine does not all contain the same gold content from each sack, which causes one party to be harmed. And 3) seen from the relation between the two, namely the implementation of wage systems and norms that occur in the farming group, there are still many that are not directly proportional or not in accordance with the rules of syara law 'especially from the wage system they use, due to lack of understanding of the concept or wage rules Islamic law has been stipulated, meaning that there are still many inappropriate relationships between the system and the pay norms in the mining group.
