Abstract

INDONESIA : Berdasarkan Pasal 1 ayat (1) Peraturan Pemerintah Nomor 97 Tahun 2014 Tentang Penyelenggaraan Pelayanan Terpadu Satu Pintu menyatakan bahwa PTSP adalah pelayanan secara terintegrasi dalam satu kesatuan proses dimulai dari tahap permohonan sampai dengan tahap penyelesaian produk pelayanan melalui satu pintu. Namun pada kenyataannya penyelenggaraan pelayanan tersebut belum dapat dilakukan secara terintergrasi dalam satu pintu, karena masih tumpang tindihnya aturan serta belum sinkronnya koordinasi dengan dinas-dinas terkait sehingga belum memberikan kepastian hukum. Adapun tujuan penelitian tersebut meliputi pertama; Untuk meneliti mengenai Penerapan Asas Kepastian Hukum dalam Pelaksanaan Pelayanan Terpadu Satu Pintu (PTSP) di bidang Penanaman Modal oleh Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu di Kota Bandung. Kedua, Untuk meneliti mengenai kendala-kendala yang dihadapi dalam Pelaksanaan Pelayanan Terpadu Satu Pintu (PTSP) oleh Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu di Kota Bandung serta Penerapan Asas Kepastian Hukum di bidang penanaman modal. Ketiga, Untuk meneliti mengenai upaya yang dilakukan oleh Dinas Penanaman Modal dan Pelayanan Terpadu Satu Pintu di Kota Bandung dalam Pelaksanaan Pelayanan Terpadu Satu Pintu (PTSP) di bidang Penanaman Modal untuk menciptakan Asas Kepastian Hukum. Metode Penelitian yang digunakan dalam penelitian ini adalah metode deskriptif analisis yuridis empiris yang artinya penelitian yang memberikan gambaran mengenai fakta-fakta yang ada (empiris) serta analisis yang akurat mengenai peraturan perundang-undangan yang berlaku dihubungkan dengan teori-teori hukum dan praktik dari pelaksanaan aturan hukum yang ada. Teori yang digunakan adalah Teori Negara Hukum sebagai Grand Theory, kemudian untuk melihat hubungan antar peraturan perundang-undangan yang menjadi sumber hukum primer pada penelitian ini digunakan Teori Kepastian Hukum sebagai Midle Theory dan untuk meneliti digunakan Teori Hukum Penanaman Modal sebagai pisau analisis atau Applied Theory. Berdasarkan penelitian yang dilakukan dapat diketahui pertama: Pelaksanaan Aturan kebijakan yang telah dibuat mengenai PTSP belum sepenuhnya bisa memberikan kepastian hukum bagi masyarakat. Sebab PTSP belum terintegrasi dalam satu kesatuan proses dimulai dari tahap permohonan sampai dengan tahap penyelesaian produk pelayanan melalui satu pintu. Kedua: Kendala-kendala yang dihadapi dalam pelaksanaan Pelayanan Terpadu Satu Pintu di bidang Penanaman Modal adalah permasalahan terkait kelembagaan; permasalahan terkait keamanan, politik, sosial budaya; permasalahan terkait ekonomi daerah; permasalahan terkait tenaga kerja; permasalahan terkait infrastruktur fisik. Ketiga: Upaya pemecahan masalah dan langkah kedepannya yang perlu dibenahi adalah. 1) Kelembagaan, 2) Keamanan, politik, sosbud. 3) Ekonomi daerah. 4) Tenaga kerja. 5) Infrastruktur fisik. ENGLISH : Based on Article 1 paragraph (1) of Government Regulation No. 97 of 2014 concerning the Implementation of One Stop Integrated Service states that PTSP is an integrated service in one unified process starting from the request stage until the completion of the product through one door. But in reality the implementation of these services can not be done integrated in one door, because still overlapping the rules and has not synchronized coordination with the related agencies so as not to provide legal certainty. The objectives of the study include first; To examine the application of the Principle of Legal Certainty in the Implementation of One Stop Service (PTSP) in the field of Investment by the Investment Department and One Stop Service in Bandung City. Second, To examine the obstacles faced in the Implementation of One Stop Integrated Service (PTSP) by the One Stop Service and One Stop Service in Bandung City as well as the application of the principle of legal certainty in the field of investment. Third, To examine the efforts undertaken by the Office of Investment and Integrated Services One Door in Bandung in the Implementation of One Stop Integrated Service (PTSP) in the field of Investment to create the Principle of Legal Certainty. The research method used in this research is descriptive method of empirical juridical analysis which means research which gives description about existing facts (empirical) as well as accurate analysis of the applicable laws and regulations related to legal theories and practices of the implementation of the rules existing law. Theory used is the Theory of the State of Law as the Grand Theory, then to see the relationship between legislation that became the primary source of law in this study used the Theory of Legal Certainty as the Midle Theory and to examine the use of Investment Law Theory as a knife of analysis or Applied Theory. Based on the research conducted can be known first: Implementation Policy rules that have been made about the PTSP has not been fully able to provide legal certainty for the community. Because the PTSP has not been integrated in a single process starting from the stage of the request until the completion of service products through a single door. Second: The constraints faced in the implementation of One Stop Integrated Service in the field of Investment is institutional related issues; issues related to security, politics, social culture; problems related to the regional economy; labor-related issues; issues related to physical infrastructure. Third: Troubleshooting efforts and future steps that need to be addressed is. 1) Institutional, 2) Security, politics, societies. 3) Regional economy. 4) Labor. 5) Physical infrastructure.
