Abstract

ENGLISH Baitul Maal wat Tamwil is one type of Microfinance Institution that uses the principle of shari'ah. BMT contributes to the movement of a small economy that is very real by directly entering into small entrepreneurs by providing funding and channeling funds to them. In a legal relationship between fellow legal subjects the need for legal protection to provide security for the parties. This study aims to find out: (1) Violations of Law at BMT Istiqomah so that it is frozen, (2) Legal Protection for frozen BMT customers, (3) Sharia Economic Law Norms regulate legal protection for customers. This research departs from the framework that legal protection is to provide protection to human rights that are harmed by others and that protection is given to the community so that they can enjoy all the rights granted by law. The research method used in the research is descriptive method with data collection techniques in the form of observations at BMT Istiqomah, interviews, with BMT customers named Ibu Hj. Yuyun and literature study. Furthermore, the data is analyzed by classifying the collected data according to the purpose of the study, which ultimately concludes. The results of the study showed that the BMT filled in the law of violating the law by not returning the customer's savings, then the BMT liquidated unilaterally and there was no legal protection felt by the customers. BMT including financial institutions which are the responsibility of supervision by the OJK and the Financial Services Authority Regulation Number: 1 / POJK.7 / 2013 concerning Financial Services Consumer Protection are implementing regulations of Law Number 21 of 2011 concerning the Financial Services Authority. Legal protection by OJK is provided through the provision of information and education to the public related to BMT activities while repressive legal protection is given by the OJK through Article 30 of Law No. 21 of 2011 concerning OJK, namely the claim rights by the OJK in order to obtain compensation from the party causing losses to consumers. Operational events at Istiqomah BMT are also not in harmony with sharia values, namely in carrying out transactions must uphold the principle of justice, the principle of doing good, the principle of truth, the principle of mutual help, and the principle of trust. INDONESIA Baitul Maal wat Tamwil merupakan salah satu jenis Lembaga Keuangan Mikro yang menggunakan prinsip syari’ah.BMT memberikan konstribusi pada gerak roda ekonomi kecil yang sangat nyata dengan langsung masuk kepada pengusaha kecil dengan memberikan pembiayaan maupun penyaluran dana kepada mereka. Dalam suatu hubungan hukum antara sesama subyek hukum perlunya adanya perlindungan hukum untuk memberikan rasa aman bagi para pihak. Penelitian ini bertujuan untuk mengetahui: (1) Pelanggaran Hukum di BMT Istiqomah sehingga dibekukan, (2) Perlindungan Hukum terhadap nasabah BMT yang dibekukan, (3) Norma Hukum Ekonomi Syariah mengatur tentang perlindungan Hukum terhadap nasabah. Penelitian ini bertolak dari kerangka pemikiran bahwa perlindungan hukum adalah memberikan pengayoman kepada hak asasi manusia yang dirugikan orang lain dan perlindungan tersebut diberikan kepada masyarakat agar mereka dapat menikmati semua hak-hak yang diberikan oleh hukum. Metode penelitian yang digunakan dalam penelitian adalah metode deskriptif dengan teknik pengumpulan data berupa observasi di BMT Istiqomah, wawancara, dengan nasabah BMT bernama Ibu Hj. Yuyun dan studi kepustakaan. Selanjutnya data tersebut dianalisis dengan mengklasifikasikan data yang terkumpul sesuai dengan tujuan penelitian, yang pada akhirnya menghasilkan kesimpulan. Hasil Penelitian menunjukan BMT Isiqomah melakukan pelanggaran Hukum dengan tidak mengembalikan tabungan nasabah, kemudian pihak BMT melakukan likuidasi secara sepihak dan tidak adanya perlindungan hukum yang dirasa oleh para nasabah. BMT termasuk lembaga keuangan yang menjadi tanggung jawab pengawasan oleh OJK serta Peraturan Otoritas Jasa Keuangan Nomor: 1/POJK.7/2013 tentang Perlindungan Konsumen Jasa Keuangan merupakan peraturan pelaksana dari Undang-Undang Nomor 21 Tahun 2011 tentang Otoritas Jasa Keuangan. Perlindungan hukum oleh OJK diberikan melalui pemberian informasi dan edukasi kepada masyarakat terkait dengan kegiatan BMT sedangkan perlindungan hukum represif diberikan OJK melalui Pasal 30 UU No. 21 Tahun 2011 tentang OJK yaitu hak gugat oleh OJK agar memperoleh ganti kerugian dari pihak yang menyebabkan kerugian pada konsumen. Oprasional yang terjadi di BMT Istiqomah juga tidak selaras dengan nilai-nilai syariah yaitu dalam melaksanakan transaksi harus menegakan prinsip keadilan, prinsip berbuat baik, prinsip kebenaran, prinsip saling tolong menolong, dan prinsip amanah.
