Abstract

INDONESIA Pariwisata halal merupakan suatu kegiatan wisata pada umumnya, namun tetap memperhatikan prinsip – prinsip syariah. Dalam kegiatan wisata halal, baik pengusaha maupun wisatawan harus memperhatikan apa yang dilarang dan apa yang dibolehkan oleh syari’at Islam. Aturan – aturan tersebut seharusnya tercantum dalam sebuah regulasi. Saat ini, yang dijadikan landasan hukum pariwisata halal adalah Undang – Undang Nomor 10 Tahun 2009 tentang Kepariwisataan, dan juga Undang – Undang Nomor 33 Tahun 2014 tentang Jaminan Produk Halal. Namun, kedua Undang – Undang tersebut hanya cukup dijadikan sebagai landasan hukum pelengkap pariwisata halal, karena tidak ada satu pasal pun yang berkaitan dengan pariwisata halal. Pengaturan pariwisata halal secara komprehensif dapat ditemukan dalam Fatwa DSN-MUI Nomor 08/DSNMUI/X/2016 tentang Pedoman Penyelenggaraan Pariwisata Berdasarkan Prinsip Syariah, namun sebagaimana diketahui fatwa DSN tidak memiliki kekuatan hukum mengikat. Maka, permasalahan penelitian terletak pada bagaimana pembentukan hukum pariwisata halal dilihat dari aspek filosofis, yuridis dan sosiologis. Kemudian bagaimana regulasi tersebut dapat diaplikasikan pada masyarakat dengan cara mengetahui sinkronisasi aturan, kinerja aparat penegak hukum dan kepatuhan masyarakat terhadap hukum pariwisata halal. Tujuannya adalah agar dapat menganalisis pembentukan dan penegakan hukum pariwisata halal di Indonesia. kerangka pemikiran penulis didasarkan pada teori the living law Van Vollenhoven dan penegakan hukum Soerjono Soekanto. Bahwa pariwisata halal merupakan hukum yang hidup, sehingga perlu ditegakkan. Jenis penelitian ini adalah yuridis – normatif, dengan menggunakan pendekatan perundang – undangan dan pendekatan konseptual. Teknik analisis dilakukan dengan cara mengklasifikasikan bahan hukum, bahan hukum diinterpretasikan dengan kerangka pemikiran, dari interpretasi bahan hukum dan kerangka pemikiran dapat ditemukan hasil penelitian. Hasil penelitian ditemukan secara filosofis, yuridis dan sosiologis hukum pariwisata sudah hidup di masyarakat, namun secara sinkronisasi hukum, kinerja aparat penegak hukum dan kepatuhan masyarakat, hukum pariwisata halal belum bisa ditegakkan, karena belum ada undang – undang yang secara khusus mengatur tentang pariwisata halal. Maka, pemerintah perlu membentuk regulasi yang secara khusus mengatur tentang pariwisata halal. ENGLISH Halal tourism generally is a tourism's activities, but still paying attention on the sharia principles. In halal tourism activities, both entrepreneurs and tourists ought to pay attention to what is prohibited and what is permitted by the Islamic sharia. And actually these rules should be listed in a regulation. Currently, the legal basis for halal tourism is Law Number 10 of 2009 concerning Tourism, and also Act Number 33 of 2014 concerning Halal Product Guarantee. However, the two laws are only sufficient to be used as a complementary legal basis of halal tourism, because there is not a single article relating to the halal tourism. Comprehensively halal tourism arrangements can be found in the DSN-MUI Fatwa Number 08/DSN-MUI[National Sharia Council of the Indonesian Ulema]/X/ 2016 concerning The Guidelines for Organizing Tourism Based on Sharia Principles, but as is well known the DSN fatwa does not have a binding legal force. Thus, the research problem lies in how the formation of halal tourism law viewed from philosophical, juridical and sociological aspects. Then how the regulation can be applied to the community by knowing the synchronization of the rules, the performance of law enforcement officials and public compliance with a halal tourism law. The aim is to able analyze the formation and law enforcement of halal tourism in Indonesia. The author's framework is based on Van Vollenhoven's theory of the living law and Soerjono Soekanto's law enforcement. That halal tourism is a living law, so it needs to be upheld. This type of research is juridical - normative, using a statutory approach and conceptual approach. The analysis technique is done by classifying legal materials, which are interpreted with a framework of thought, and from it interpretation of legal materials and the research frameworks the findings can be found. The study results were found philosophically, juridically and sociologically, a tourism law was already living in the community, but in synchronizing law, the performance of law enforcement officers and community compliance, the halal tourism law could not be enforced, because there was no laws specifically that regulated the halal tourism. So, the government needs to form the regulations that specifically regulate the halal tourism.
