Abstract

INDONESIA : Aparatur Sipil Negara merupakan pelayan bagi masyarakat, guna menciptakan pemeritahan yang baik dan optimal kepada masyarakat, sesuai dengan ketentuan yang berlaku ASN diwajibkan untuk bersikap netral dan terlepas dari intervensi politik, sesuai dengan ketentuan peraturan perundang-undangan yang berlaku, Tujuan dari penelitian ini adalah untuk memahami : (1) Pelaksanaan Pasal 9 ayat (2) Undang-Undang nomor 5 Tahun 2014 tentang Aparatur Sipil Negara terhadap pelanggaran netralitas ASN dalam Pemilihan Kepala Daerah dan Pemilihan Umum di Kabupaten Sumedang (2) Kendala Pelaksanaan Pasal 9 ayat (2) Undang-Undang nomor 5 Tahun 2014 tentang Aparatur Sipil Negara terhadap pelanggaran netralitas ASN dalam Pemilihan Kepala Daerah dan Pemilihan Umum di Kabupaten Sumedang (3) upaya terhadap Keterlibatan Aparatur Sipil Negara dalam pelanggaran netralitas. Teori yang digunakan dalam penelitian ini adalah Teori hukum yang merupakan suatu landasan dalam menerapkan norma, selanjutnya teori demokrasi yang menjadi acuan bahwa ASN memiliki hak untuk memilih, serta teori birokrasi sistem kewenangan, kepegawaian, jabatan, dan metode yang dipergunakan pemerintah untuk melaksanakan program-programnya Penelitian ini menggunakan metode deskriptif analitis dengan metode pendekatan yuridis normative data diperoleh dari hasil penelitian studi pustaka, wawancara, terkait penelitian ini. Hasil penlitian menunjukan bahwa dalam Pelaksanaan Pasal 9 ayat (2) Undang-undang nomor 5 tahun 2014 tentang ASN dalam pelaksanaanya masih dirasa belum optimal, mengingat masih adanya ASN yang terlibat dalam kegiatan politik tentunya menjadi salah satu indikator dari belum pelaksanaan aturan yang belum optimal. Adapun kendala yang dihadapi : (1) pandangan pegawai ASN yang cenderung berpihak pada atasan (2) Kesadaran pegawai ASN yang masih rendah akan bersikap netral dan menganggap hal yang sudah biasa terjadi. (3) Percepatan karir secara cepat. (4) pengawasan dan partisipasi masyarakat yang masih lemah (5) Sistem pengawasan terhadap pelanggaran netralitas ASN yang belum optimal(6) kurangnya komitmen dari masing-masing calon dan kurangnya integritas dari ASN yang melanggar. Adapun upaya yang dilakukan pertama meningkatkan pemahaman ASN terhadap asas netralitas ASN serta melakukan pengawasan sebagai upaya preventif, Upaya Kedua, Membangun kolaborasi yang efektif dengan instansi yang terkait, Upaya Ketiga, Dalam melakukan sosialisasi dan edukasi kepada seluruh elemen terkait. Keempat komitmen bersama untuk menempatkan ASN sesuai dengan kemampuan tidak melihat dari unsur kedekatan dan dukungan politik. ENGLISH : The State Civil Apparatus is a servant to the community, in order to create a good and optimal government to the community, in accordance with the applicable provisions ASN is required to be neutral and free from political intervention, in accordance with the provisions of the applicable laws and regulations. The purpose of this study is to understand: (1) Implementation of Article 9 paragraph (2) of Law number 5 of 2014 concerning State Civil Apparatus against violations of ASN neutrality in Regional Head Elections and General Elections in Sumedang Regency (2) Obstacles to Implementation of Article 9 paragraph (2) of Law number 5 of 2014 concerning State Civil Apparatuses against violations of ASN neutrality in Regional Elections and General Elections in Sumedang Regency (3) efforts towards the involvement of State Civil Apparatuses in violating neutrality. The theory used in this study is the theory of law which is a basis for applying norms, furthermore the theory of democracy which is a reference that ASN has the right to choose, as well as the theory of the bureaucratic system of authority, staffing, positions, and methods used by the government to implement its programs. This research uses descriptive analytical method with normative juridical approach method data obtained from the results of literature study, interviews, related to this research. Research results show that in the implementation of Article 9 paragraph (2) of Law number 5 of 2014 concerning ASN, the implementation is still not optimal, considering that there are still ASNs involved in political activities which are certainly one of the indicators of non-optimal implementation of rules. The obstacles faced: (1) the views of ASN employees who tend to side with superiors (2) The awareness of ASN employees who are still low will be neutral and assume things that are common. (3) Rapid career acceleration. (4) oversight and participation of the community that is still weak (5) The oversight system of violations of neutral ASN neutrality (6) lack of commitment from each candidate and lack of integrity of violating ASN. The first attempt is made to improve the understanding of ASN on the principle of neutrality of ASN and conduct surveillance as a preventive measure, Second Effort, Building effective collaboration with relevant agencies, Third Effort, in conducting outreach and education to all related elements. The four shared commitments to place ASN in accordance with their ability not to see the elements of closeness and political support.
