Abstract

INDONESIA : Partisipasi masyarakat dalam pembentukan Peraturan Daerah (Perda) merupakan isu penting dalam konteks Pemerintahan Daerah. Partisipasi masyarakat memiliki peran yang signifikan dalam proses pengambilan keputusan dan pembuatan kebijakan daerah. Dalam konteks pembentukan Perda, dalam putusan MK No. 91/PUU-XVIII/2020 bahwa partisipasi masyarakat harus dilakukan dengan lebih bermakna (meaningful participation). Oleh karena itu, partisipasi masyarakat dalam proses pembentukan Peraturan Daerah khususnya di Kabupaten Sumedang harus dilakukan secara lebih bermakna (meaningful participation). Tujuan penelitian ini adalah untuk menganalisis partisipasi masyarakat dalam penyusunan Perda Nomor 1 Tahun 2022 tentang Fasilitas Penyelenggaraan Pondok Pesantren dan perda Nomor 2 Tahun 2022 tentang Perlindungan Lahan Pertanian dan Pangan Berkelanjutan. Metode penelitian menggunakan metode yuridis empiris, sumber data dalam penelitian ini adalah data primer dan sekunder serta tersier, metode pengumpulan data melalui, studi pustaka, wawancara dan observasi.Lokasi penelitia di Kantor DPRD Kabupaten Sumedang. Analisis data dilakukan melalui content analysis untuk mengidentifikasi partisipasi masyarakat dalam proses penyusunan Perda. Landasan penelitian ini berpijak pada Teori Negara Hukum, partisipasi masyarakat dalam penyusunan Perda mencerminkan prinsip demokrasi, keadilan, dan transparansi. Selain itu, partisipasi masyarakat juga terkait dengan konsep otonomi daerah, yang memberikan ruang bagi pemerintah daerah untuk melibatkan masyarakat dalam pengambilan keputusan yang berkaitan dengan wilayah mereka. Hasil penelitian menunjukan bahwa: (1) Penyusunan Perda Nomor 1 Tahun 2022 diinisiatori oleh Dewan Perwakilan Rakyat Daerah dan Perda Nomor 2 Tahun 2022 diinisiasi oleh Pemerintah Kabupaten Sumedang melalui tahapan Identifikasi Kebutuhan, Tahap awal, Penyusunan Rancangan Awal Pembahasan di DPRD, Konsultasi Publik, Revisi dan Penyempurnaan, Pembahasan Lanjutan di DPRD, dan PengesahanPenyampaian ke Eksekutif. (2) Partsipasi masyarakat dalam Penyusunan Perda Nomor 1 Tahun 2022 melibatkan tokoh masyarakat, ulama, organisasi masyarakat Islam, dan pimpinan pondok pesantren dan dalam Penyusunan Perda Nomor 2 Tahun 2022 melibatkan unsur masyarakat yang terkait dengan sektor pertanian, seperti kelompok tani dan petani. (3) Implementasi meaningful participation dalam pembuatan Peraturan Daerah Nomor 1 Tahun 2022 dan Perda Nomor 2 Tahun 2022 di Kabupaten Sumedang belum dilaksanakan secara efektif dan belum adanya peraturan pelaksana yang mengatur tentang partisipasi masyarakat yang lebih bermakna, sehingga konsep meaningful participation ini masih multitafsir dan mengambang. ENGLISH : Community participation in the formation of Regional Regulations (Perda) is an important issue in the context of Regional Government. Community participation has a significant role in the process of decision-making and regional policy making. In the context of forming regional regulations, in the Constitutional Court decision no. 91/PUU-XVIII/2020 that community participation must be carried out in a more meaningful manner (meaningful participation). Therefore, community participation in the process of forming Regional Regulations, especially in Sumedang Regency, must be carried out in a more meaningful manner (meaningful participation). The purpose of this study was to analyze community participation in drafting Regional Regulation Number 1 of 2022 concerning Facilities for Implementing Islamic Boarding Schools and Regional Regulation Number 2 of 2022 concerning Protection of Sustainable Agricultural Land and Food. The research method uses empirical juridical methods, the data sources in this study are primary and secondary data as well as tertiary, data collection methods are through literature, interviews and observation. The research location is in the Sumedang Regency DPRD Office. Data analysis was carried out through content analysis to identify community participation in the regional regulation drafting process. The basis of this research is based on the rule of law theory, community participation in the drafting of regional regulations reflects the principles of democracy, justice and transparency. In addition, community participation is also related to the concept of regional autonomy, which provides space for regional governments to involve the community in making decisions related to their territory. The results of the study show that: (1) The drafting of Regional Regulation No. 1 of 2022 was initiated by the Regional People's Legislative Assembly and Regional Regulation No. 2 of 2022 was initiated by the Government of Sumedang Regency through the stages of Needs Identification, Initial Stage, Preparation of Preliminary Draft Discussion in DPRD, Public Consultation, Revision and Completion, Further Discussion in the DPRD, and Approval Submission to the Executive. (2) Community participation in drafting Regional Regulation No. 1 of 2022 involves community leaders, clerics, Islamic community organizations, and leaders of Islamic boarding schools and in drafting Regional Regulation No. 2 of 2022 it involves elements of the community related to the agricultural sector, such as farmer groups and farmers. (3) Implementation of meaningful participation in making Regional Regulation No. 1 of 2022 and Regional Regulation No. 2 of 2022 in Sumedang Regency has not been implemented effectively and there are no implementing regulations governing more meaningful community participation, so the concept of meaningful participation is still multi-interpreted and floating.
