Abstract
INDONESIA : Penyelundupan manusia merupakan kejahatan transnasional yang terorganisasi, di mana para pelakunya memfasilitasi orang lain dalam melakukan penyeberangan perbatasan secara ilegal untuk mendapatkan keuntungan. Pelaku penyeludupan manusia diancam dengan sanksi pidana sebagaimana diatur dalam Undang-Undang Nomor 6 Tahun 2011 tentang Keimigrasian. Saat ini, kasus penyeludupan manusia di Indonesia terus meningkat setiap tahunnya, hal ini menjadi perhatian bagi pemerintah dan penegak hukum Indonesia. Kasus penyeludupan manusia menjadi masalah terhadap keamanan manusia dan keamanan nasional. Penelitian ini bertujuan untuk menganalisis tentang penegakan hukum terhadap tindak pidana penyeludupan manusia di Indonesia, dan peran keimigrasian dalam memberantas tindak pidana penyeludupan manusia, serta hambatan dan upaya penegak hukum dalam memberantas tidak pidana penyeludupan manusia di Indonesia. Sebagai bahan analisis, penelitian ini menggunakan teori negara hukum yang mengkaji tentang konsep negara hukum dan jaminan HAM. Teori penegakan hukum yang mengkaji tentang lembaga penegak hukum Indonesia dan faktor-faktor yang mempengaruhi penegakan hukum, serta problematika penegak hukum Indonesia. Teori tujuan pemidanaan dan teori penyeludupan manusia. Metode pendekatan penelitian yang digunakan yaitu metode yuridis empiris. dengan pendekatan perundang-undangan (statue approach), pendekatan konseptual (conseptual approach), dan pendekatan kasus (case approach). Adapun jenis data yang digunakan yaitu jenis data primer, yang bersumber dari bahan hukum primer, sekunder, dan tersier. Lokasi penelitian dilakukan di Mabes Polri dan Direktorat Jenderal Imigrasi KemenkumHAM. Sebagai penelitian empiris, populasi yang digunakan adalah Kepolisian Republik Indonesia, dan Direktorat Jenderal Imigrasi.teknik pengumpulan sampel dilakukan dengan menggunakan teknik purposive sampling. Adapun teknik pengumpulan data dilakukan melalui wawancara, dokumentasi, dan kepustakaan. Berdasarkan hasil penelitian, penegakan hukum terhadap pelaku penyeludupan manusia belum efektif karena protokol people smuggling memberikan perlindungan kepada pelaku penyeludup. Adapun peran Pejabat imigrasi antara lain pejabat imigrasi dapat melakukan penyidikan terhadap kasus penyeludupan manusia, pelaku yang terbukti akan diancama dengan sanksi pidana paling singkat 5 tahun dan paling lama 15 tahun. Selain itu, pejabat imigrasi diberikan wewenang untuk mengambil tindakan administratif berupa deportasi bagi pelaku penyuludup. Adapun yang menjadi hambatan dalam penegakan hukum yaitu penegak hukum tidak memiliki kewenangan yang luas untuk menjerat pelaku karena adanya pertimbangan hukum internasional dan yurisdikis. Selain itu, dalam proses penyidikan masih terdapat tumpang tindih kewenangan. Adapun upaya pemberantasan tindak pidana penyeludupan manusia yaitu penyidik Polri dan PPNS harus saling melakukan koordinasi. Melakukan kerjasama baik secara internasional, maupun dengan masyarakat dan media massa. ENGLISH : People smuggling is an organized transnational crime, in which the perpetrators facilitate other people's illegal border crossings for profit. Perpetrators of people smuggling are threatened with criminal sanctions as stipulated in Law Number 6 of 2011 concerning Immigration. Currently, cases of human smuggling in Indonesia continue to increase every year, this is a concern for the Indonesian government and law enforcement. Human smuggling cases are a problem for human security and national security. This study aims to analyze law enforcement against criminal acts of people smuggling in Indonesia, the role of immigration in eradicating criminal acts of people smuggling, as well as obstacles and efforts by law enforcement in eradicating people smuggling in Indonesia. As the material for analysis, this research uses rule of law theory which examines the concept of rule of law and human rights guarantees. Law enforcement theory examines Indonesian law enforcement agencies and the factors that influence law enforcement, as well as the problems of Indonesian law enforcement. The theory of sentencing purposes and the theory of people smuggling. The research approach method used is the empirical juridical method. with statutory approach (statute approach), conceptual approach (conceptual approach), and case approach (case approach). The type of data used is primary data, which comes from primary, secondary, and tertiary legal materials. The location of research was carried out at the National Police Headquarters and the Directorate General of Immigration at the Ministry of Law and Human Rights. As an empirical study, the population used is the Indonesian National Police and the Directorate General of Immigration. The sample collection technique was carried out using a purposive sampling technique. The data collection technique is done through interviews, documentation, and literature. Based on research results, law enforcement against people smugglers has not been effective because the people smuggling protocol provides protection to smugglers. The role of immigration officials, among others, immigration officials can conduct investigations into cases of people smuggling, perpetrators who are proven will be threatened with criminal sanctions for a minimum of 5 years and a maximum of 15 years. In addition, immigration officials are given the authority to take administrative action in the form of deportation for interlocutors. As for the obstacles in law enforcement, namely law enforcers do not have broad authority to prosecute perpetrators because of considerations of international law and jurisdiction. In addition, in the investigation process, there is still overlapping authority. As for efforts to eradicate criminal acts of people smuggling, namely, Polri investigators and PPNS must coordinate with each other. Collaborate both internationally, as well as with the public and the mass media.
