Abstract

INDONESIA: Permohonan hak asuh anak yang dimohonkan kepada Pengadilan Agama Jakarta Selatan dikabulkan dan hak asuh anak jatuh kepada ayah. Hak asuh anak idealnya diberikan kepada pihak Ibu karena anak masih dibawah umur. Namun dalam kasus perceraian antara ayah selaku Pemohon dan ibu selaku Termohon, hakim memiliki pertimbangan hukum lain. ENGLISH: The application for child custody applied to the South Jakarta Religious Court was granted and custody of the child fell to the father. Child custody should ideally be given to the mother because the child is still a minor. However, in the case of divorce between the father as the Applicant and the mother as the Respondent, the judge has other legal considerations.
