Abstract

INDONESIA: Penelitian ini dilatar belakangi oleh perjanjian kerja sama antara Mitra Shopee dan Vendor PT. Barokah Amanah Sentosa (BAS) yang merupakan bentuk hubungan bisnis berlandaskan kesepakatan antara kedua belah pihak. Dalam era ekonomi digital dan ekosistem e-commerce yang berkembang pesat, kerja sama antara platform marketplace dan vendor menjadi elemen krusial dalam rantai pasok dan layanan logistik. Namun, hubungan hukum dalam perjanjian ini sering kali menimbulkan tantangan dalam hal kepastian hukum, perlindungan hak-hak mitra, serta kepatuhan terhadap regulasi yang berlaku. Tujuan penelitian ini adalah untuk mengetahui pelaksanaan Undang – Undang Nomor 6 Tahun 2023 tentang Cipta Kerja dan Asas Perlindungan Hukum terhadap Kepatuhan Perjanjian kerja, mengetahui hubungan kontraktual dan akibat hukum dari tidak terpenuhinya hak dan kewajiban antara antara Mitra Shopee, vendor PT. Barokah Amanah Sentosa (BAS) dan PT. Shopee Indonesia. Penelitian ini menggunakan kerangka pemikiran diantaranya Teori Tujuan Hukum dari Sisi Kemanfaatan Hukum sebagai grand theory Teori Perjanjian Kerja dan Undang- Undang Nomor 6 Tahun 2023 tentang Cipta Kerja sebagai middle theory, dan Teori Perlindungan Hukum sebagai applied theory. Penelitian ini menggunakan metode penelitian deskriftif dengan pendekatan Yuridis Empiris yang mengkaji hukum dalam realita yang terjadi, jenis dan sumber data dalam penelitian ini menggunakan bahan hukum primer yang terdiri dari hasil penelitian lapangan didukung dengan bahan hukum sekunder yang terdiri dari peraturan perundang- undangan yang terkait dan bahan hukum tersier yang terdiri dari kamus hukum dan ensiklopedia hukum, metode penelitian yang digunakan yakni dekriptif analitis yakni menggambarkan secara sistematis dan menguraikan permasalahan serta menjawab permasalahan yang terjadi atas objek yang diteliti. Teknik pengumpulan data yang digunakan yakni penelitian kepustakaan dan penelitian lapangan, dengan teknik analisis data secara kualitatif dengan cara inventarisasi data, klasifikasi dan penafsiran data. Hasil penelitian ini adalah, pelaksanan kepatuhan perjanjian kerja secara lisan yang terjadi antara Mitra Shopee, Vendor PT. Barokah Amanah Sentosa (BAS) dan PT. Shopee Indonesia ini dalam pelaksanannya belum sesuai dengan ketentuan hukum yang berlaku. Mitra Shopee (kurir) hanya memiliki kontrak langsung dengan PT. Barokah Amanah Sentosa (BAS) sebagai pihak vendor, bukan dengan PT. Shopee Indonesia dimana PT. Barokah Amanah Sentosa (BAS) bertindak sebagai perantara yang menyediakan jasa kurir untuk Shopee. Dampak hukum dari tidak terpenuhi hak dan kewajiban Mitra Shopee (kurir) berdampak pada lemahnya kepastian hukum dan meningkatnya potensi secara industrial, secara sosial Mitra Shopee (Kurir) menghadapi kerentanan ekonomi, kesehatan, serta kesenjangan sosial yang menurunkan martabat pekerja yang mengakibatkan perlindungan hukum masih bersifat formal dan belum efektif dalam praktik gig economy. ENGLISH: This research is motivated by the cooperation agreement between Shopee Partners and Vendors of PT. Barokah Amanah Sentosa (BAS), which is a form of business relationship based on mutual agreement. In the era of the digital economy and the rapidly growing e-commerce ecosystem, collaboration between marketplace platforms and vendors has become a crucial element in the supply chain and logistics services. However, the legal relationship within these agreements often poses challenges in terms of legal certainty, protection of partners' rights, and compliance with applicable regulations. The purpose of this research is to determine the implementation of Law Number 6 of 2023 concerning Job Creation and the Principle of Legal Protection regarding Compliance with Employment Agreements, as well as to understand the contractual relationship and legal consequences of non-fulfillment of rights and obligations between Shopee Partners, vendors of PT. Barokah Amanah Sentosa (BAS), and PT. Shopee Indonesia. This research utilizes a conceptual framework including the Theory of Legal Purposes from the Legal Benefit Perspective as the grand theory, the Theory of Employment Agreements and Law Number 6 of 2023 concerning Job Creation as the middle theory, and the Theory of Legal Protection as the applied theory. This research employs a descriptive research method with an Empirical Juridical approach that examines law in its actual context. The data types and sources used in this study utilize primary legal materials, consisting of field research results, supported by secondary legal materials consisting of related laws and regulations, and tertiary legal materials consisting of legal dictionaries and legal encyclopedias. The research method employed is analytical descriptive, which systematically describes and outlines the issues and answers to the problems encountered in the research object. Data collection techniques used include library research and field research, with qualitative data analysis techniques through data inventory, classification, and interpretation. The results of this study indicate that the implementation of compliance with the verbal employment agreements between Shopee Partners, Vendors of PT. Barokah Amanah Sentosa (BAS), and PT. Shopee Indonesia does not comply with applicable legal provisions. Shopee Partners (couriers) only have a direct contract with PT. Barokah Amanah Sentosa (BAS) as the vendor, not with PT. Shopee Indonesia, where PT. Barokah Amanah Sentosa (BAS) acts as an intermediary providing courier services for Shopee. The legal impact of Shopee Partners' (courier) rights and obligations not being met results in weak legal certainty and increased potential industrial harm. Socially, Shopee Partners (couriers) face economic and health vulnerabilities, as well as social disparities that undermine workers' dignity. This results in legal protection remaining formal and ineffective in the gig economy.
