Abstract

INDONESIA: Penelitian ini dilatarbelakangi oleh kebutuhan akan jasa pengiriman barang semakin meningkat seiring dengan meningkatnya aktivitas jual beli dan pengiriman barang dari tempat yang jauh. Hal ini mendorong munculnya berbagai perusahaan jasa pengiriman barang, baik milik pemerintah maupun swasta, seperti PT. Global Jet Ekspress. Namun, dalam pelaksanaannya, tidak jarang terjadi kendala seperti kerusakan barang saat pengiriman. Dalam kasus wanprestasi, di mana barang tidak sampai dalam kondisi baik atau barang hilang, perusahaan jasa pengiriman memiliki tanggung jawab untuk memberikan ganti rugi kepada konsumen. Tujuan penelitian tesis ini yaitu: (1) Untuk mendeskripsikan dan menganalisis ganti rugi (Ta’widh) yang diberikan PT. Global Jet Express terhadap pengiriman atas barang yang rusak atau hilang. (2) Untuk mendeskripsikan dan menganalisis ganti rugi (Ta’widh) barang yang rusak atau hilang ditinjau dari hukum ekonomi syariah. (3) Untuk mendeskripsikan dan menganalisis faktor pendukung dan penghambatnya di PT. Global Jet Ekspress. Kerangka pemikiran pada penulisan ini berlandaskan kepada teori perlindungan hukum. Melalui teori tersebut diharapkan dapat memberikan keterangan tentang ganti rugi yang diberikan oleh PT. Global Jet Ekspress. Pada penulisan karya ilmiah ini metode yang digunakan adakah metode deskriptif-analisis dengan landasan empiris. Metode deskriptif bertujuan menggambarkan secara tepat sifat-sifat suatu individu, keadaan, gejala, atau menentukan ada tidaknya hubungan antara suatu gejala dengan gejala lain dalam masyarakat. Hasil penelitian menunjukkan tiga poin utama. Pertama, PT. Global Jet Ekspress memberikan ganti rugi atas kehilangan atau kerusakan barang kepada pelanggan dengan nilai 10 kali biaya pengiriman dan akan di ganti sesui niminal yang hilang apabila di asuransikan dengan nilai maksimal Rp 20.000.000. Kedua, Melihat dari ganti rugi yang diberikan pihak PT. Global Jet Ekspress yang hanya memberikan 10 kali lipat ongkos kirim apabila tidak di asuransikan maka ganti rugi yang diberikan oleh pihak PT. Galobal Jet Ekspress tidak sesuai dengan Hukum Ekonomi Syariah. Ketiga, faktor pendukung akan meminimalisir terjadinya kerusakan dan kehilangan pada barang dan ada beberapa faktor penghambat yang membuat tidak sampai pada penerima. Secara keseluruhan, dapat disimpulkan bahwa PT. Galobal Jet Ekspress memberikan ganti rugi sesuai dengan syarat dan ketentuan yang sudah mereka buat. ENGLISH: This research is motivated by the increasing need for goods delivery services along with the increase in buying and selling activities and sending goods from distant places. This has encouraged the emergence of various goods delivery service companies, both government and private, such as PT. Global Jet Express. However, in its implementation, problems often occur such as damage to goods during delivery. In cases of default, where the goods do not arrive in good condition or the goods are lost, the delivery service company has the responsibility to provide compensation to the consumer. The objectives of this thesis research are: (1) To describe and analyze the compensation (Ta'widh) provided by PT. Global Jet Express for delivery of damaged or lost goods. (2) To describe and analyze compensation (Ta'widh) for damaged or lost goods in terms of sharia economic law. (3) To describe and analyze the supporting and inhibiting factors at PT. Global Jet Express. The framework for this writing is based on the theory of legal protection. Through this theory, it is hoped that it can provide information about the compensation provided by PT. Global Jet Express. In writing this scientific work, the method used is a descriptive-analytical method with an empirical basis. The descriptive method aims to accurately describe the characteristics of an individual, circumstances, symptoms, or determine whether there is a relationship between a symptom and other symptoms in society. The research results show three main points. First, PT. Global Jet Ekspress provides compensation for lost or damaged goods to customers with a value of 10 times the shipping cost and will be reimbursed according to the nominal value lost if insured with a maximum value of IDR 20,000,000. Second, looking at the compensation provided by PT. Global Jet Ekspress which only provides 10 times the shipping cost if it is not insured, the compensation will be given by PT. Galobal Jet Ekspress is not in accordance with Sharia Economic Law. Third, supporting factors will minimize damage and loss to goods and there are several inhibiting factors that prevent them from reaching the recipient. Overall, it can be concluded that PT. Galobal Jet Ekspress provides compensation in accordance with the terms and conditions they have created. ARABIC: الدافع وراء هذا البحث هو تزايد الحاجة إلى خدمات توصيل البضائع مع زيادة أنشطة البيع والشراء وتسليم البضائع من أماكن بعيدة. وقد شجع ذلك على ظهور العديد من شركات خدمات توصيل البضائع، الحكومية والخاصة على حد سواء، مثل شركة PT Global Jet Express. ومع ذلك، ليس من غير المألوف أن تحدث عقبات أثناء تنفيذها، مثل تلف البضائع أثناء التسليم. وفي حالة حدوث تقصير، حيث لا تصل البضاعة في حالة جيدة أو تلف البضاعة، تتحمل شركة خدمات التوصيل مسؤولية تقديم تعويض للمستهلكين. أهداف البحث في هذه الأطروحة هي (1) وصف وتحليل التعويضات (Ta'widh) التي تقدمها شركة جلوبال جيت إكسبريس عن تسليم البضائع التالفة أو المفقودة. (2) وصف وتحليل التعويضات (Ta'widh) عن البضائع التالفة أو المفقودة من حيث الشريعة الإسلامية. (3) وصف وتحليل العوامل الداعمة والمثبطة في شركة PT Global Jet Express. يعتمد إطار العمل في هذه الورقة على نظرية الحماية القانونية. ومن المتوقع من خلال هذه النظرية توفير معلومات حول التعويضات التي تقدمها شركة PT Global Jet Ekspress. الطريقة المستخدمة في كتابة هذا العمل العلمي هي الطريقة الوصفية التحليلية ذات الأساس التجريبي. يهدف المنهج الوصفي إلى وصف خصائص الفرد أو الموقف أو العَرَض بدقة، أو تحديد ما إذا كانت هناك علاقة بين العَرَض والأعراض الأخرى في المجتمع أم لا. تظهر نتائج البحث ثلاث نقاط رئيسية. أولاً، تقدم شركة PT Global Jet Ekspress تعويضًا عن فقدان أو تلف البضائع للعملاء بقيمة 10 أضعاف تكلفة الشحن، وسيتم استبدالها وفقًا للقيمة المفقودة إذا كان مؤمنًا عليها بقيمة أقصاها 20,000,000 روبية إندونيسية. ثانيًا، وبالنظر إلى التعويض الذي تقدمه شركة PT Global Jet Ekspress والذي لا يقدم سوى 10 أضعاف تكلفة الشحن إذا لم يكن مؤمنًا عليه، فإن التعويض الذي تقدمه شركة PT Global Jet Ekspress لا يتوافق مع الشريعة الإسلامية. ثالثًا، العوامل المساعدة تقلل من حدوث تلف وفقدان البضاعة وهناك العديد من العوامل المانعة التي تجعلها لا تصل إلى المستلم. وعموماً، يمكن استنتاج أن شركة بي تي جالوبال جت إكسبريس تقدم تعويضاً وفقاً للشروط والأحكام التي وضعتها.
